So, let the jury decide if "I'll smack the shit out of you is a threat" means that you want the other person to believe you will physically hurt them. It'd would be an astonishing and insincere interpretation to claim that those words don't mean what they mean from someone who has gone on an angry an emotional tirade for several minutes.Just like party B doesn't get to behave like...animals...party A doesn't get to behave like an animal just because he's offended. Everyone in society is responsible for keeping themselves in check. Who knows if it can be proven and convicted it might help dissuade this "culture of violence" I keep hearing about. Or you know we can just go on and pretend it isn't what it is. |
