As I mentioned in my other posts, it would not be easy for an officer to have to fish into his/her pocket for a Metrocard in the heat of hot pursuit. Also while the perp may have been adept at turnstile jumping, the bar above the turnstile to deter jumpers could have injured an officer trying to jump it. As for no one having an affirmative duty to assist the police, while that may apply to an ordinary citizen, a person such as the station agent who has the means to assist has a duty bound obligation to do so. |
