If it were true that the clerk did see the officer, and could identify him as such, then the clerk should have released the gate. But we don't know if those circumstances were the case or not. Generally, no one has an affirmative duty to assist the police, but only not stand in their way. This seems unusual for the police to assert that the failure of the clerk to involve himself in the police activity, by helping the officers enter the station area, is a criminal offense. The story told by the officers seems especially suspicious given that they had, or should had, a MetroCard with them at the time; and also that the bad guy was able to enter the station by jumping the turnstile, and these officers should have been in good enough physical shape to have done the same. Although not all the facts might yet be out, this does seem to raise the specter of lazy or out-of-shape officers.
