That sounds like a reasonable penalty clause. Avoids ridiculous drawn out litigation between HR + SEPTA, but lets them recover some of the cost. That's sound business practice, still assume open ended consequential damage claims are barred by the contract, but reasonable costs get recovered. Sort of like when they give you a loaner car if your car gets recalled for a major safety defect where they tell you to stop driving it, and don't have the parts in stock to fix it.
