But the next question is rather simple: regardless of what governmental entity that public records indicate owns a particular right of way, in practice, what does it actually mean? Does it really make much difference if the city, the Transit Authority, the MTA, or even the state owns a piece of property? In the end, it is public property. Laws and politics will govern what is done or not done with it. And even if it were private property, the government could condemn it, and laws and politics rule anyway. |
