Yes. And for that exact reason hate crimes should not exist. The criminal ought to be brought to justice because he or she is robbing someone else. That the criminal hates old people ought not, in and of itself, be a crime.

Everyone who rides public transportation ought to have the same protection. That is, criminals should have the same deterrents against committing crimes for the entire population, for otherwise criminals (or at least the smarter ones) will target those individuals not in protected classes.

(Use the same reasoning and consider: are enhanced penalties for committing a crime against an employee of a public transportation system proper? Are the paying passengers of a public transportation system less worthy of the protection of the laws than the system employees who voluntarily accepted the conditions and risks of the job? Should there be a difference in the penalty assessed against a criminal who assaults a bus driver as opposed to one who assaults the driver of an 18-wheeler hauling cargo? Should there be a distinction between employees of public transit systems that are directly and actually engaged in the movement of a vehicle, versus those who are indirectly involved, e.g., conductors and dispatchers?)
