SCHMIDT A federal judge on Thursday ordered the City of New York to take several corrective actions to reverse what he has ruled were years of intentional discrimination against minority applicants to the Fire Department. In a 57-page memorandum, the judge, Nicholas G. Garaufis, of Federal District Court in Brooklyn, said the city needed to compensate those minorities who took the discriminatory entrance exams, which were offered between 1999 and 2007, and create fairer ones. Judge Garaufis said that the roughly 7,400 minority applicants who took the tests in question should have the opportunity to apply for compensation from the city. Of that group, 293 applicants who were deemed qualified, but are still not firefighters, should be given priority hiring status and retroactive seniority. The city also has to come up with a new testing procedure for prospective firefighters unless it can validate that the current test treats minorities fairly. The judge’s memorandum came a week after he ruled that the city had intentionally discriminated against black applicants by continuing to use an entrance exam that it had been told put them at a disadvantage. The decision was particularly noteworthy because it was believed to be the first time the court had found that the city had intentionally discriminated against a large group of people. In damning language, Judge Garaufis said the city looked the other way in regards to the discrimination and that it had “uniquely disabling effects.” Judge Garaufis said in his order on Thursday that “these forms of relief are simple in concept, but will be complex in execution.” He added, “Achieving these basic aims will require ongoing oversight, attention to myriad details and resolution of disputes among the parties.” Judge Garaufis declined the request of the Vulcan Society, which brought the suit, to implement hiring quotas for the department. Suzanne B. Goldberg, a professor of law at Columbia University and an expert on employment discrimination, said that although Judge Garaufis did not order quotas, the ruling still validated the position of the Vulcan Society, a fraternal organization of black city firefighters. “The court says that hiring quotas are appropriate in only certain circumstances,” Ms. Goldberg said in a telephone interview. “The judge clearly outlined a serious response to the decades of discrimination, but it appears that he just wants to do it in a different way. It’s not surprising, because quotas have a hot-button history.” |

Bush. NYC is appealing the ruling, and I hope that they win, and that the Court of Appeals vacates the summary judgment entered in favor of the US and the Vulcan Society. I have explained my differences with Judge Garaufis' reasoning in several posts. |

Explain how there could be racism if not enough minorities pass a test?They had the opportunity to study and prepare, what is the problem. Why not administer another test and leave race off of the application. This way when the results come in, the truly qualified will get the highest scores. Is the SAT racist? Is any test racist? |

It supports my claim that President Bush tried to do whatever he could to help as many people as possible. THis is why he named minorities to high level positions, this was the basis for no child left behind and this is why he wasn't as tough on illegals as I would have wanted. That said, I totally disagree with him on this issue however, I can understand his reasoning behind it. You cannot get any more right wing than myself. |

"Is the SAT racist?"Indirectly....YES.....how you may ask? if little Sally and little Johnny attend Greenwich High School in Greenwich, CT.....do you think for one moment they are going to score LOW on the SATs? no way....Joe....but if little Sally and Little Johnny attended Roosevelt High School in Roosevelt, LI, they are more likely to score lower since the student to teacher ratio is quite high there at that school which in conclusion leads lower grades. Here are 2 examples of suburban high schools, one where parents throw money at public school education because they are capable of doing so and and another school where the parents are more on financial assistance and the school budget can not meet the demands of the students because the parents don't have the financial means to approve expanding budgets year after year. So to answer your question, yea....one can study and one can prepare, but if the person came from an EDUCATIONAL deprived background to begin, they are less likely to be able to pass the exam...do you get it? |

Great examples and thank you for the information!But this is not racism. People of all races can fit into the categories you described above. For example, the Asian people... They are minorities but do not qualify for minority scholarships. Many come from educational deprived backrounds and even language barriers but for some reason they seem to excel. Why? I think a big part of it is culture and personal responsibility. Little Sally & Johnny may be black and live in Greenwich. I think blacks are allowed up there or little Sally & Johnny may be white and live in Canarsie and attend Canarsie High school. |

"Why is it that Rbseabeach and ChrisR16 love to give out one liners? for example....utter nonsence ....without any creditable evidence to support their claim to the opposite? are they afraid to stand by and say there is no way in hell that the test can't be baised? that maybe the way the test is written in such a way that academically deprived individuals don't have a rats chance at passing this test? maybe ChrisR16 and rseabeach should both sit down and take the firemens test and see if they can pass without any prepping.....lets see now...lol |

Most Asian aren't discriminated in where they want to live. Most Asians attend CRAM EXAM COURSES....there are plently of them in Asian areas...like in Flushing, NY...designed for test taking..they are NOT FREE...they COST MONEY....DUDE....which all members of the family sacrifice to help the next generation succeed in life. Fine, I will be happy to take the test. In my years of education & training, I did not always score at the top. WHen I did not score at the top, I didn't blame the test, I blamed myself for not trying harder or having a more complete grasp of the academic material.If I take the firemen's test and do not pass it, it is my fault for not preparing. It has nothing to do with the test. |

It is probably their culture The point is anyone else can do the same thing. It has nothing to do with racism. Many of the other groups have been here for a much longer period of time. I do not have to spend precious time searching for all types of details through various search engines to respond to topics and posts. I use those research tools for my profession. This is just a past time. |
