He said that years ago. The military tribunals are different now. We don't know if he'd do it now. Why should we decide based on what he wants? He wants a military tribunal so he can argue to the Muslim world that he is a soldier for Allah. Why should we let him?

Holder, consulting with DOD, decided on the best forum for trying each defendant based on where he thought it was most likely to gain a conviction. depending on the offense, the location and the evidence. Until you know the evidence he has, in particular, you can't credibly second-guess the decision. Holder is, if anything, a cautious lawyer who weighs decisions carefully. This was not lightly decided.

Actually, it's KSM because no one wants to bother having to spell it out; here, it's shorthand independent of politics. If I didn't have the name on the screen in front of me, I would probably botch the spelling.

That can be treated as a separate instance---as can Shanksville. Those charges can be held in reserve.

However, civilian craft was used to use them, and thus jurisdiction isn't clear. Furthermore, it's a target within the USA.

It's 52%, but even so, that was last year. He's lost a lot of that support already. The independents put Obama in, and they are the same ones he is losing rapidly.
Still trying to use last year's talking points, eh. And even if using last year's talking points (as if they mean anything in the present), at least get the numbers right.

Holder gets convictions and death sentences. Look at his time as Deputy Attorney General.
With all due respect for the JAG Corps, they were in the dual situation of public defenders and prosecutors in types of cases that they had never tried before and it showed. The public defenders were having more success then the prosecutors. If you want these people brought to justice you should applaud Holder but you seem to want to continue to coddle them in Cuba.
