Holder, consulting with DOD, decided on the best forum for trying each defendant based on where he thought it was most likely to gain a conviction. depending on the offense, the location and the evidence. Until you know the evidence he has, in particular, you can't credibly second-guess the decision. Holder is, if anything, a cautious lawyer who weighs decisions carefully. This was not lightly decided. |
