"Enemy combatant" is a contrived designation. It does exist in written law. They are not members of a standing army. Therefore, military law dictates they be treated under civilian law. The bombers of the Cole, however, are different. The Cole is a military installation, any crime against it or its crew is a military issue.KSM can be tried in military courts only for the Pentagon plane aspect of 9/11. Defendants get far more latitude in military courts. Better to let this play out first. |
