How's that? When it came to the Civil War, the crime was the secession. Slavery was still legal until near the Civil War's end. Secession isn't. Immigration is civil law, not criminal law. Local police do not have the authority to enforce itl

Ah, but they DO have the legal authority to notify those that do have the authority to enforce it while holding someone that is arrested.

Not exactly bingbong. Local police cannot be conscripted to do Immigration enforcement, but they can notify and also must comply with hold requests from ICE. California’s law creating criminal penalties for complying with immigration enforcement is likely unconstitutional based on current preemption case law.

Nothing I've seen would indicate any public officials are doing that. They're simply not helping ICE to detect.

I would agree that no city employee should ever be giving false info to ICE or they would be in violation of the statute. But not giving info at all - that's just like you not turning in an employee at your local deli who you suspect of being an illegal.

Again, I agree making a public statement welcoming illegals would be a violation. But stating that you won't go out of your way to turn them into ICE wouldn't be.

That's possible. However, immigration law by no means mandates status be inquired, checked or reported by local law enforcement, who are empowered to enforce criminal law. Immigration law is not criminal law.

Hmm. What I see is that this law authorizes ICE to issue detainer requests. I don't see where it says that the recipient is required to comply with the request.

I met Ben Stein in a hotel lobby in Washington DC about 20 years ago. Before approaching him I was warned by another person there who knew him NOT to mention Ferris Bueller’s Day Off.

The question is not whether or not it's a must versus can notify situation, the point of this is they can, and if they choose to, that's well within the scope of their employment

The bottom line is law enforcement get along with each other, and they will help each other out. Helping out a brother LEO trumps covering up for an illegal alien.

Except that a police commissioner can decide that crime is best reduced by reassuring illegals that they will not be reported to ICE if they report a crime.
