Local police cannot be conscripted to do Immigration enforcement, but they can notify and also must comply with hold requests from ICE. California’s law creating criminal penalties for complying with immigration enforcement is likely unconstitutional based on current preemption case law.

They're simply not helping ICE to detect. I would agree that no city employee should ever be giving false info to ICE or they would be in violation of the statute. But not giving info at all - that's just like you not turning in an employee at your local deli who you suspect of being an illegal. "encourage or induce" Again, I agree making a public statement welcoming illegals would be a violation. But stating that you won't go out of your way to turn them into ICE wouldn't be.

However, immigration law by no means mandates status be inquired, checked or reported by local law enforcement, who are empowered to enforce criminal law. Immigration law is not criminal law.
