I did not read the actual draft opinion, but it seems to be correct. Whether or not one thinks abortion should be legal, the question that the Court is addressing is whether Roe's finding of a "right" to abortion in the Constitution is correct. The answer to this seems to be a pretty clear "no" - it is not a Constitution-based right - it is not addressed either positively or negatively in the Constitution.The result of such a decision would be to return the abortion issue to the realm of any other issues handled legislatively - generally at the level of state legislatures. Thus, each state could determine whether or not abortion should be legal there, including putting a right to abortion in the state's constitution. You may think that abortion should be allowed on demand anywhere on the US, or be totally banned, but that's a political view to be addressed by elected representatives - as a strict legal matter, the Court is purportedly saying that this is simply not a matterby the Constitution. subfan |

This reads like a Justice Alito opinion and there are no slip ups as if someone was trying to mimic his style. It would also make sense if the vote was initially 5-4 with Chief Justice joining those appointed by Democrats that Justice Thomas, as the most senior in the majority, would assign to Justice Alito.This release strikes me as either someone on either side of the original decision trying to get someone to change their vote. Either Justice Alito lost the majority because Justices Kavanaugh and/or Barrett flipped or one appears wavering so the dissent is trying to put out a full court press. |

Do I believe that Roe was wrongly decided, yes, but I do think there is a legal basis under the Constitution for permitting abortions until the point of viability. |

To set the groundwork, the ninth amendment states:"The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people". Roe was decided in the basis of the right to privacy, so trying to attach it to the ninth amendment post facto is more than a bit of a stretch. I'd be curious about any other rights found to exist solely on account of the ninth's catch-all language - are you aware of any? subfan |

I know that Catholics also oppose abortion, but I don’t have the same hatred for Catholics. And their opposition seems more consistent to me, they also oppose capital punishment and I disagree with that too.I don’t have a problem with them liking names from the Hebrew Bible, it’s part of the Christian Bible too, and you know full well I support so-called “cultural appropriation.” Heartbeat is a terrible argument against abortion. Other animals have heartbeats too, it doesn’t make them human. The importance of the heart is overstated because ancient ignorant people thought the heart was the source of the self, when it’s nothing but a pump. If you replaced the heart with an artificial pump that didn’t use a reciprocating action to pump, then a person would be fully alive with no heartbeat. I’ve always favored assigning the beginning of humanity (not “life”) to the development of the fetus’s brain. The only legitimate argument against abortion is in the third trimester or possibly late in the second trimester. |
