Women of Color Dominate...

I will concede he has not said it MUST be a woman of color, but as this current article reports, he has encouraged enormous speculation among Democrats (and the Press) that he WILL pick a "woman of color."

If he picks someone else, it will put in him in the position of having to explain why.

Note by the way that Tammy Duckworth is a woman of color but not black.

I agree his short list has few if any women on it all of whose ancestry is from western Europe. Maybe Gretchen Whitmer.

How about if you again cite that portion of the mid-20th century immigration and naturalization act that makes you a citizen by virtue of birth if one parent is a citizen and has lived in the US for x years since age 14 (which Obama's mother hadn't because she was only 18 years old and x > 4).

The problem with that is that people nevertheless do not consider "citizenship from birth" synonymous with "natural born citizenship." Sane people still consider Tammy Duckworth and Ted Cruz to be US Citizens, but some of them might legitimately believe that they are ineligible to the presidency.

Since the only difference between naturalized citizens and natural-born citizens is whether or not they can run for president, it's not something that comes up often enough for there to be a lot of case law on the topic.

I brought up McCain because he came the closest to becoming president while being born abroad, as he was the only such major party nominee. And the response was that he was an exception because he was born on a "military installation," which is just pure ignorance because being born on a military base has never meant anything. Note that the Panama Canal Zone had special rules as of the time of McCain's birth and until it ceased to exist, but this had nothing to do with being a "military installation." A person born on Diego Garcia will not automatically become a US Citizen.

OK. But if someone wishes to challenge Cruz or Duckworth, they have to bring a case along the lines of "Yes I agree this person was a citizen on the day s/he was born, and has never lost their citizenship since, but I still contend that they do not fit the definition of "natural born citizen," despite the fact that this term isn't actually defined anywhere."

Nothing is certain, but I would that that person's chances of winning their argument are pretty slim.

So how many years is x? I forget and can't find it with a Google search.

People have done this and all such cases have been dismissed due to lack of standing.
