It could have been a deadly series of events. Had they not restrained his neck and on his stomach, he would not have died.

George Floyd died Monday from a combination of preexisting health conditions exacerbated by being held down by Minneapolis officers, not from strangulation or asphyxiation, based on the medical examiner’s initial report.

Preliminary findings from a Tuesday autopsy conducted by the Hennepin County Medical Examiner found “no physical findings that support a diagnosis of traumatic asphyxiation or strangulation,” according to the criminal complaint filed Friday against former officer Derek Michael Chauvin.

“Mr. Floyd had underlying health conditions including coronary artery disease and hypertensive heart disease,” said the complaint from the Hennepin County Attorney. “The combined effects of Mr. Floyd being restrained by police, his underlying health conditions and any potential intoxicants in his system likely contributed to his death.”

The Minneapolis police officer fired earlier this week was charged Friday with third-degree murder and manslaughter after kneeling on Mr. Floyd’s neck for 8 minutes and 46 seconds. Video showed he was unresponsive for the last 2 minutes and 53 seconds.

“Police are trained that this type of restraint with a subject in a prone position is inherently dangerous,” the complaint said.

Well Ed Koch relieved him of his duties in 1979 or so. He got to be more than 85 years old. It probably doesn’t matter how old he is for the task at hand but when you’re around for about 60 years you’re bound to be a little controversial somewhere.

Does it matter?
You saw what happened to the man, just like everyone else did.

Doesn't matter what "they say killed him".
What we saw was a man being murdered by 3 police officers, while one played look out.
Guess your president didn't think These were "fine people",since he called them THUGs..
Guess they have to run over someone,killing them. But obviously, when the President actually says he's looking forward to seeing SHOOTINGS..its time for this scumbag to go.

My guess is when Floyd said he can't breathe, Derek Chauvin(fascinating name) did not take it seriously and felt it was a taunt or escalation based on Garner on SI.

Chauvin figured Floyd was running his mouth using a famous quote from a police brutality case and kept his knee on. Chauvin was not going to give in he figured and now he killed someone.

I would have preferred someone other than Baden. He likes seeing his name in the news and tends to deliver the report he's paid to deliver, if you catch my meaning. But a second autopsy is warranted given the circumstances.

They key word is also "potential". There is no certainty there was any.

One can also day of asphyxiation that does not leave a physical trace for an autopsy to discover: per Dr Sanjy Gupta.

Only in this case it was mechanical asphyxiation (external pressure prevents breathing), which always leaves traces. And even when the asphyxiation is due to non-mechanical events, there are traces, i.e., evidence. "There are non-specific physical signs used to attribute death to asphyxia. These include visceral congestion via dilation of the venous blood vessels and blood stasis, petechiae, cyanosis and fluidity of the blood."

Elements (a)(2) - (7) do not apply. Where's your evidence that the killing was premeditated (a)(1)? Murder, very likely, but not First Degree.

2019 Minnesota Statutes

609.185 MURDER IN THE FIRST DEGREE.

(a) Whoever does any of the following is guilty of murder in the first degree and shall be sentenced to imprisonment for life:

(1) causes the death of a human being with premeditation and with intent to effect the death of the person or of another;

(2) causes the death of a human being while committing or attempting to commit criminal sexual conduct in the first or second degree with force or violence, either upon or affecting the person or another;

(3) causes the death of a human being with intent to effect the death of the person or another, while committing or attempting to commit burglary, aggravated robbery, kidnapping, arson in the first or second degree, a drive-by shooting, tampering with a witness in the first degree, escape from custody, or any felony violation of chapter 152 involving the unlawful sale of a controlled substance;

(4) causes the death of a peace officer, prosecuting attorney, judge, or a guard employed at a Minnesota state or local correctional facility, with intent to effect the death of that person or another, while the person is engaged in the performance of official duties;

(5) causes the death of a minor while committing child abuse, when the perpetrator has engaged in a past pattern of child abuse upon a child and the death occurs under circumstances manifesting an extreme indifference to human life;

(6) causes the death of a human being while committing domestic abuse, when the perpetrator has engaged in a past pattern of domestic abuse upon the victim or upon another family or household member and the death occurs under circumstances manifesting an extreme indifference to human life; or

(7) causes the death of a human being while committing, conspiring to commit, or attempting to commit a felony crime to further terrorism and the death occurs under circumstances manifesting an extreme indifference to human life.

(b) For the purposes of paragraph (a), clause (4), "prosecuting attorney" has the meaning given in section 609.221, subdivision 2, paragraph (c), clause (4).

(c) For the purposes of paragraph (a), clause (4), "judge" has the meaning given in section 609.221, subdivision 2, paragraph (c), clause (5).

(d) For purposes of paragraph (a), clause (5), "child abuse" means an act committed against a minor victim that constitutes a violation of the following laws of this state or any similar laws of the United States or any other state: section 609.221; 609.222; 609.223; 609.224; 609.2242; 609.342; 609.343; 609.344; 609.345; 609.377; 609.378; or 609.713.

(e) For purposes of paragraph (a), clause (6), "domestic abuse" means an act that:

(1) constitutes a violation of section 609.221, 609.222, 609.223, 609.224, 609.2242, 609.342, 609.343, 609.344, 609.345, 609.713, or any similar laws of the United States or any other state; and

(2) is committed against the victim who is a family or household member as defined in section 518B.01, subdivision 2, paragraph (b).

(f) For purposes of paragraph (a), clause (7), "further terrorism" has the meaning given in section 609.714, subdivision 1.

It doesn't matter if Floyd had "intoxicants" in his system or not. If "restraint by the police" is a "contributing factor", then Chauvin is legally responsible. In other words, but for Chauvin's actions, Floyd wouldn't have died.

I rewatched that horrifying video. Chauvin keeps his knee on Floyd's neck for eight minutes and fifty seconds. He keeps his knee on Floyd's neck for a full three minutes after Floyd stops moving or breathing. Even after another cop checks for a pulse, Chauvin doesn't take his knee off Floyd's neck. That suggests wanton intent on Chauvin's part.

They are trying to twist this any way they can to avoid a conviction.
