Personally I think the answer to the question is the same at least when it involves customized cakes. My reading of existing precedent leaves some debate about whether a baker can refuse if they have stock cakes or other baked goods in the display case if those are used without customization so that is why I framed it the way I did. |

Many people are asserting that a business cannot refuse someone who chooses not to wear a mask, yet support businesses refusing customers whose product and/or service requests violate the store owner's "beliefs". What if the owner's "belief" is that people who don't wear masks in his or her shop, might be spreading a dangerous disease? |

The First Amendment protects a business from state retaliation if it chooses not to serve someone who is not wearing a mask just as they can refuse to serve at least certain products that would endorse messages they find objectionable (Happy Birthday Dolph, Congratulations Adam and Steve, etc.). It does not protect from private shaming by those who believe that mask requirements are a threat to our civil liberties and post on social media shaming those businesses that require masks for service. |

And even if a baker is not within his rights to refuse to make a gay wedding cake, they are still within their rights to refuse someone who isn't wearing a mask. It's not discrimination against a particular class of people. It's the same as "no shoes, no shirt, no service" though with safety rather than decorum being the underlying reason. |
