Presumably (if there is any truth to this at all, and considering the source, who knows) Stone's lawyer wanted her rejected for cause, but the judge said no, and Stone's lawyer used his peremptory challenges on riskier people. |

The judge asked all the questions. I answered as I stood at the bench between the defended and his counsel on my right and the states attorney on my left. The judge then ask the lawyers if I should remain in the pool of prospective jurors. Both lawyers said no. John in the sand box of Maryland's eastern shore. |

I have been call four times in my life for jury duty, three time at the state level and once at the federal level. At the state level I was seated once and dismissed twice. From my experience, both as an Attorney and being called for jury duty, a lot depends on the individual Judge and the nature of the case. A simple car accident case that will be tried within a week, most Judges won't be bothered to be present during voir dire and will instead rely on their Law Secretary to be the Judge's eyes and ears. Others take the bench in all cases even if they are not paying full attention just so potential jurors don't attempt to lie or just to make sure attorneys get to the point of their questioning of potential jurors. However, major cases will usually involve active participation by the Judge. I was once called for a tobacco litigation that was expected to take 8 weeks. Thankfully I was not chosen, but the Judge was even more grueling with some potential jurors than the attorneys were. As an Attorney if you don't want to be there I am not going to force you since most Judges (at least at State level) will allow an unlimited number of challenges despite what rules may say. If a Judge is being a pain about number of challenges usually the ones who are quite obvious about not wanting to be there I won't get an objection if I say it is for cause. I only recall one time where adversary objected to a challenge for cause, but as soon as she did the Law Secretary said to her that he knows which statement was the basis for my challenge and that she really does not want to take this to the Judge. Attorney got the hint because it was a statement that I could have struck the entire pool over but I chose not to because I was confident in the rest of the pool if I used all of my peremptory challenges plus this one challenge for cause. |

As a juror quite a few times, I can tell you that it varies, even within NY State. Not surprisingly, judges are much more likely to be completely involved, or do the questioning themselves, in criminal cases. It may also have changed over time. |
