NYPD Commissioner James O'Neill has terminated former Police Officer Daniel Pantaleo, for using a prohibited chokehold while attempting to arrest Eric Garner, who died shortly thereafter.

The whole NYC legal and law-enforcement system perpetuates a lie that can be debunked just by watching a video. It was a takedown maneuver. Anyone who knows a tiny bit about physiology knows that people who are choking cannot speak.

This bit of lawlessness on the part of the commissioner will come back to bite him on his rear end.

Anyhow, my brother told me yesterday what was going to happen, since he's "in the know". In 2019, the Mayor, and in turn his underling, the P.C., would rather placate the savages than use evidence to make this decision, so they fire him. Now, what this does is give Pantaleo the opportunity to sue the Police Department and the City in a Court of Law, NOT the NYPD Trial Room. Of course, in using facts and evidence, not emotional hyperbole, Pantaleo will win, so when the trial ends and he wins money, the City/P.D. offers to reinstate him, under the condition that he quietly retires with a vested pension, his "good guy" letter, and his settlement (probrably 7 figures).

I seriously disagree. If Pantaleo takes the city to court, the NYPD will put on their Patrol Guide expert, a couple of Academy Instructors, and dissect the video.

This won't be as easy for Pantaleo to beat as he might think. Anyway, I think the NYPD will reach a partial-pension settlement with Pantaleo long before any civil case gets in front of a judge. The city doesn't want this dragged out any further.

They held a properly constituted administrative hearing at which evidence was presented. There is no need to use court findings. He isn't charged with a crime.

Based on the report of the investigation, that the O’Neal used paints a damning picture. It was a conclusion he concurred with and that report ignored politics.

Which is the point, according to the Commissioner's recount of the events leading to Mr Gardners death, that Pantaleo should have released the hold on his throat. He did not. THAT is why he was fired.

Someone that would do that does not belong on any police force, showing they do not have the ability to exercise good judgment in a tense crisis situation. Police must be up to that task, to ensure they exercise their duties with minimal violence.

1. Those were almost certainly agonal respirations. He was unconscious and unresponsive in the video by the time he was supine on the ground.

The responding EMS crew sealed his fate by not doing shit for Garner at the scene. That's why they lost their jobs long before Pantaleo did, and rightfully so. All those two crews saw was a Black man in police custody, and that was enough to cause Garner to become dehumanized in their eyes. That's a deadly thing in any EMS system, and it's why FDNY hits medical ethics so hard these days.

All this over loosies, which the city itself created a market for, by grossly overtaxing packaged cigarettes. Now there's a bitter irony!

The finding of the ALJ was that the preponderance of the evidence indicated that he held the suspect in a manner contrary to allowed NYPD procedures.

1. Pantaleo directly violated the Patrol Guide and several operations orders, and O'Neill's summary spells that out in detail.

2. As previously mentioned, the EMS crews did nothing in a timely manner, and that conclusively sealed his fate.

3. But for Pantaleo's actions, the gross negligence of the medics wouldn't have happened, and Garner would still be alive today.
