FBI moves in on last four occupiers at Oregon wildlife refuge

Federal agents on Wednesday closed in on the last four anti-government militants still holed up at the Malheur National Wildlife Refuge in Oregon after a 40-day-old armed occupation, the FBI said in a statement.

The Federal Bureau of Investigation said no shots have been fired and that negotiations to end the occupation without violence were continuing.

The four protesters were indicted last week along with 12 others previously arrested on charges of conspiring to impede federal officers during the standoff at the compound.

The takeover at Malheur, which began on Jan. 2, was sparked by the return to prison of two Oregon ranchers convicted of setting fires that spread to federal property in the vicinity of the refuge.

The occupation, led by Ammon Bundy, also was directed as a protest against federal control over millions of acres public land in the West.

Bundy and 10 others were arrested in January in Oregon, most of them during a confrontation with the Federal Bureau of Investigation and state police on a snow-covered roadside where a spokesman for the group, Robert "LaVoy" Finicum, was shot dead. A 12th member of the group turned himself in to police in Arizona.

The FBI said its agents moved to contain the remaining four holdouts Wednesday evening after one of the occupiers drove an all-terrain vehicle outside the barricades previously set up by the self-styled militia members at the refuge.

FBI agents attempted to approach the driver, and he sped away back to the compound, after which federal agents "moved to contain the remaining occupiers by placing agents at barricades both immediately ahead of and behind" their encampment, the FBI said.

A number of the occupiers were relating their account of events as they were unfolding via an independent Internet broadcast, "Revolution Radio," that is known to be sympathetic to the occupation.

One woman said FBI agents had moved to within 50 yards (45 meters) of the occupiers' position in the compound. One protester identifying herself as Sandy Anderson reported seeing FBI snipers posted on a nearby hillside with high-beam vehicle lights trained on the compound.

"If they tear gas us, it's the same as firing on us," she said, adding, "Don't come in. Don't do it."

It was not immediately clear how much farther law enforcement officers would go in the latest confrontation. Until Wednesday, FBI and police had largely kept their distance from the buildings occupied by the militants, sealing off access to the refuge headquarters with roadblocks.

However, the standoff has reached a point where it became necessary to take action to ensure everyone's safety, Greg Bretzing, special agent in charge of the FBI in Oregon, said in a statement.

"It has never been the FBI's desire to engage these armed occupiers in any way other than through dialogue, and to that end, the FBI has negotiated with patience and restraint in an effort to resolve the situation peacefully," the statement said.

So.....once you sell everything your family owns of any value....which includes the gun collection BTW....you get to pay off any creditors first, then the government lien on you for those millions of unpaid grazing fees gets satisfied, THEN you can buy counsel to get you out of the mess of your own making.

Should the legal bills exceed your net worth at that point, then you can apply for and receive publicly funded counsel.

Should have thought about this before you didn't pay your bills. Payback is a bitch. Welcome to your section 8 apartment retirement, seeing your kids chose to follow in your cloven footsteps and are languished in in the next cell block. That is, when you're released from Federal prison. Lulz.

His net worth could be close to zero.

Given that he has over $1 million worth of money that he owes to the people of the United States in (very low) grazing fees, if he can't make it economically on those terms, he's not a good rancher either, along with being someone who makes a habit of threatening to murder people.

According to the usual sources, it's OK to threaten to kill cops if they are trying to arrest you for stealing from the federal government or for destroying federal government property.

Don't you understand that the federal government has wrongfully seized land that originally belonged to the State and people of Nevada?

Bottom lne is, he should liquidate those assets and then satify his creditors, then the government's lien for unpaid grazing fees, then what's left (aside from homestead claims of his wife if applicable) goes to hs defense. After that's paid, if he needs, he can apply for public defense funding. Otherwise, it's bullshit.

Any "normal" defendant would be forced to do so. THIW. Equal justice applies to RWers too.

Yep. Not very good land, seems he's overgrazed it. But its still land, which could renew if left to and be useable if properly managed once again.

Then he owns structures and machinery which can be sold, as it has value. Has a house. It's got value, all real estate has value. Chances are the original mortgage has been paid off, he's been living there quite some time. We know he has a gun collection. That could produce revenue when sold off. Vehicles, furnishings, household silver and jewelry.

I'm sure he could squeeze enough out of it after creditors and those grazing fee liens are satisfied. He had a cashflow producing concern there, didn't he?

LOL. The executive branch doesn't own the land. Congress can and does make laws concerning the use of the land. The Supreme Court rules on the constitutionality of those laws and on the legality of applicable executive orders.

The Bureau of Land Management is a division of the Department of the Interior, an executive branch agency. They just asserted their ownership.

The Supreme Court rules on the constitutionality of those laws and on the legality of applicable executive orders

That is not part of the USSC's powers. And there is no constitutionality of "executive orders" as if they were decrees; furthermore, the existence of the Department of the Interior is a violation of Article 4 Section 3 Clause 2.

Excellent question.

Homeowners aren't indigent. Same goes for business owners. Ranches are businesses. Bundy owns a home and a ranch, plus whatever additional assets he has....like the money he never paid the government, perhaps?

The sole exception to this rule is Medicaid coverage for long term care for the elderly, where one can retain their primary residence and still qualify for coverage under the government program. But one still has to liquidate everything else.

It's a cruel, cold world in republcan rules yunno. And they apply to everyone, including Cliven Bundy.

Actually, NY has a program that, if you buy and keep a sufficiently complete long term healthcare coverage policy, you qualify for Medicaid when its coverage runs out, without your remaining assets going to the state.

Wasn't aware of that. Regardless, it's a state program, not Federal. I'm only considering Fed rules since Bundy's not in NY. But there's a good reason why he might think he ought to be.

The Congress shall have power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States; and nothing in this Constitution shall be so construed as to Prejudice any Claims of the United States, or of any particular State

Given that Congress approved the creation of that ministry of state in 1849 for the purpose of land management and management of domestic affairs, I don't see how the DoI conflicts with this clause.

I know you are being sarcastic. It's worth reminding people that most Federal land was taken from the Indians well before there were many white ranchers out there to stake claims, and well before many of the state governments even existed.

I agree the Mormon part is uncalled for. One unacceptable word out of a whole rant, and I didn't see it. Besides, threatening to murder law encorcement officers if they try to arrest you isn't part of the Mormon faith, that's for sure!

The moron part, not so much. What kind of a fool announces he is going to Oregon when he should know the authorities are waiting to arrest him as soon as he leaves the safety of his ranch?

There's a federal public defender program if you're indigent, arrested, and charged with a federal crime. There are also private attorneys who are appointed pro bono by the federal courts to represent indigent clients.

By "that's not how it works" I meant the accused usually isn't required to sell all assets in order to "prove" indigence. Oftentimes the accused can gather financial documents and prove to the judge that he/she lacks the funds for a private lawyer. If Bundy has financial documents prepared by a CPA that show he has little or no net worth (e.g., loans outstanding that equal or exceed the value of his collateral plus equity in the land and buildings), then he should qualify for a federal public defender.

But bingbong was claiming that Bundy's net worth is significantly positive. So, under her assertion, that is how it works.

I would expect Bundy's net worth is significantly positive, unless he is just incompetent. Lots of his fellow ranchers are still in business despite paying their grazing fees to the BLM. If Bundy can't make money while not paying grazing fees, he's even more of a fool than otherwise evident.

Well, unless you and Bingbong are Bundy's accountants, then neither of you know. Bingbong claims a lot of things and she's almost always wrong. If Bundy has a net worth that's greater than the maximum allowed under the federal PD program, then he will have to pay his attorney himself (or get others to pay it for him).

But you didn't deny her claim that Bundy has assets. She started with the premise that Bundy has assets, and asserted that therefore he can't get a public defender.

You replied, "That's not how it works," which is incorrect. You may have meant "How do you know Bundy has assets" but that's not what you said.
