Dutta goes on to admit that police officers aren't perfect and some have been known to be corrupt bullies, but he says your best bet is to swallow your pride, stay quiet and submit to any unlawful actions by police. One of the tactical officers in Ferguson was indefinitely suspended last night for threatening to "F**king kill" a protester if he/she didn't move back. It was caught on camera. |

After all, simply saying "I don't consent to that search" counts as "mouthing off" and therefore justifies the cop shooting you. It's like the constitution doesn't even mean anything anymore. |

It's far safer to comply and then complain than it is to fight the battle out in the streets.The problem is that complaining doesn't do anything. Who are you going to complain to? It's very rare that any police department is subject to any oversight— the CCRB in New York is the exception, not the rule. The only effective way to "complain" after the fact is by suing the police department (or the city, etc) and that requires that you assert yourself on the street— if you "comply" with an illegal search or seizure, the courts will assume you "consented" to it, making it impossible to sue. Moreover, you'd be wise to have a video recording of the incident so you can prove it happened, which will inevitably require you to disregard the cops' (illegal) order to stop recording. |

Agreed. The few encounters I've had with police (all traffic stops)... I've just wanted to get out of the situation alive, and without getting roughed up. I honestly believe that the police are out of control. I think that many are so used to getting away with things, that they're almost always willing to cross the line.Years ago I recall Giuliani, and Safir announcing that NYPD officers would be addressing people they encounter as Sir/Madam and so on. My thought then was... That's fine and dandy if that happens, but most importantly I think people simply don't want to be abused (verbally and/or physically) when dealing with police. |
