Mississippi Gov. Bryant Signs 'Turn away The Gays' Bill Into Law

Mississippi Gov. Phil Bryant (R-Brandon) signed the "Religious Freedom Restoration Act" into law Thursday afternoon, making his state the first in the nation where people and businesses can refuse goods or services to anyone, based on a "strongly held religious belief". The bill, which was passed Tuesday by the GOP-dominated Legislature, is widely understood to be aimed at the state's LGBT community, and is the most far-reaching legislation of its type in the United states. Beyond merely legalizing discrimination, the new law grants people the ability to "defy any state laws, rules, regulations, and municipal and county ordinances", so long as such defiance was based on the "exercise of religious beliefs". Although supporters of the law claim the measure "only mirrors a federal law passed during the Clinton Administration", legal experts note that nothing in the federal religious-freedom statute allows or encourages discrimination.




"This is a return to the Jim Crow era," said LGBT legal analyst Sheldon Green. "This law says it's OK to not only refuse service to a gay person, a black person, a woman, what have you, but allows them to flout the law and claim religious exemptions. I cannot imagine anything more dangerous." Governor Bryant, who took an active role in crafting the legislation, said "Today, I am proud to sign this bill, which will protect the religious liberty of all Mississippians." Advocates of the law, such as the anti-LGBT Family Research Center's Tony Perkins, clearly stated its intent before a crowd of fellow supporters in Jackson, the state capital. "Whether it’s someone like Pastor Telsa DeBerry who was hindered by the Holly Springs city government from building a new church in the downtown area, or a wedding vendor, whose orthodox Christian faith will not allow her to affirm same-sex ‘marriage,’ the provisions of RFRA would apply to prevent the government from discriminating against religious exercise," Perkins stated. ”The Founders never envisioned a government forcing Americans to choose between the basic teachings of their faith and losing their livelihood.”




Legal scholars said the law was a "direct attempt to bypass earlier legislation, such as the Johnson-era Civil Rights Act" which ended segregation in Southern states during the late 1960s. "Now, when it will most likely be both seen and used as a shield against enforcement of civil rights laws (current and future), enacting it seems like a uniquely poor idea," wrote Jonathan Kendall, a former judge, to the state legislature. "This is an enormous step backward in American life and law," said Kevin Quigley of the LGBT Legal Rights Project. "If I were gay or lesbian and living in Mississippi, I'd be packing my bags right now." Mississippi is the first of over a dozen states with similar "Turn Away The Gays" bills pending before lawmakers, including Oklahoma, Missouri, Tennessee, Ohio, and Kansas. Nearly all of them have been introduced by Tea Party factions within the GOP.




Mississippi's law takes effect on July 1.

The Honorable Salaam Allah and I, among others, do not like the Tea Party but I think we disagree on the merits of this legislation. Many of my dear friends at United Van Lines are proud members of the LGBTQIA Community.

True that. But I second Quigley's quote from my story in the OP: Anybody who is gay or lesbian, and lives in Mississippi, needs to relocate outside the state forthwith.

My big concern is that enactment of this law will encourage the OTHER sixteen states considering it, to do likewise, making a goodly portion of the country patently unsafe for people like me.

I've been asked, FOUR times already this afternoon, if I would participate in a campaign to cite my "religious beliefs" against Tea Partiers. Given how eager they are to use hate to galvanize their base, I'm wondering if that wouldn't be such a bad idea.

On a related note, watch the "mainstream media" in the coming weeks. I'm about to produce an event that will make history this June, and have the Tea Partiers running screaming into the night. It involves a VERY old, VERY conservative institution, which is going to host an LGBT event for the first time ever. Limbaugh and Beck will know my name, and be VERY upset about it. :)

Well, presumably he's black or gay or some other demographic subject to discrimination, and if one is subject to discrimination then the conclusion that it is unsafe to visit an area where that discrimination is codified into law is obvious.

Laws like Mississippi's give the imprimatur of legality to greater and greater expressions of hatred, which can be exempted from judicial action by claiming "religious belief". The Mississippi law allows people to exempt their actions from every OTHER "state, local or municipal law, rule, or regulation", so long as they claim religious belief.


This means, according to my friends at Lambda Legal, a person in Mississippi can claim they were following Biblical edicts by putting a gay man to death, and avoid a murder charge. That is hardly a condition I would call "safe".

Not to make light of the situation but in the highly likely event you do go down there to report confront protest call it what you will I hope you will seriously consider taking Greyhound or Amtrak or a boat to suitable harbors such as can be found in Pascagoula, Gulfport, Biloxi, or someplace like that. There is no need none whatsoever to consider any other mode of transportation.

I suspect there's a number of folks who were sitting on the fence after Obama disappointed them and considered voting republican this time around. I also suspect that once they get wind of where the republicans are at and are going even further crazy, that they'll either vote democrat or won't be voting republican at all and just stay home.

It's not a "gay issue." The law allows business owners to turn away anybody as long as they say "religion" afterwards.

If you genuinely believe that white people in Mississippi won't deny service to black people when the law says they can, then you must be a racist.

Actually since blacks are a "protected" class under federal law, they can't turn away blacks under the guise of religion. They get away with this without using the term gay as gays are not a "protected" class under federal law.

The law says they can.

That blacks are a protected class is irrelevant— the business isn't turning anybody away because they're black (at least not officially), they're turning people away because their religious beliefs tell them to. That all the people turned away happen to be black is completely incidental, honest!

Its like a vegetarian boycotting outback Steak House.

Outback allows vegetarians on the premises. They even have salads and fish on the menu!

You don't seem to be getting it. The law allows businesses to turn away anybody as long as they claim it's because of "religious beliefs." They don't have to explain what those beliefs are, and courts are specifically barred from challenging the legitimacy of religious beliefs anyway.

Racists will ban black people because they're racist, and the law allows them to do exactly that as long as they say "I did it for religious reasons."
