He wasn't charged with that. Dropping the murder charge and charging him with a lesser felony is almost as bad as dropping the charges. It will anger the usual suspects and it will be focused on the prosecutor. This is why any prosecutor worth his/her salt provides a safety valve by including lesser charges they can fall back upon if the murder case falls apart. Any anger then can be directed at the jury.
