As Sotomayor's confirmation hearings approach, and the racial angle gets more and more attention, it's important to determine whether she actually is a minority and whether she actually did face discrimination in her pastHow is that important? The 14th Amendment rules here, not European Union-style "hate crime" laws. It's more important that she intends to uphold the oath of office: "I, Sonia Maria Sotomayor, do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as Associate Justice of the Supreme Court of the United States, under the Constitution and laws of the United States. So help me God." |
