The date of the election is set by statute. Congress could change the date if it so desired. The only problem is that the Constitution does set the dates when the new Congress and the president are sworn in, regardless of whether an election were held, and in the absence of an election, the seats would be vacant. So if the election are postponed or cancelled, Chuck Grassley* would become the president on January 20, 2021.*Senator Grassley is the President Pro Tempore of the US Senate, and the only person in the line of succession whose term doesn’t end on 1/20/21 or earlier. |
