I know it’s anecdotal, but at least downstate the Judges bent over backwards to set bail at a level that the Defendant could afford if the Judge felt that bail was necessary. This was a “solution” in search of a problem. The same “problem” could be solved by giving Judges the discretion in misdemeanor cases and more limited felonies than the bail deform law provides to suspend enforcement of bail conditions for the first offense. This way if the person keeps getting picked up for criminal activity the Judge can then revoke the bail and remand to custody. |
