Chief Justice Roberts also seems to have a pathological fear of not being the next Roger Taney and if a case like Masterpiece Cakeshop comes before the Court again, but without the procedural issues, and Justices Gorsuch, Alito, Thomas, and Kavanaugh write a screed that could be interpreted as saying any anti-discrimination law is unconstitutional, does Chief Justice Roberts find a narrow reason to side with the other four Justices?
