He could write his own very narrow opinion, to make it clear that a majority did not support the more sweeping view.This must have happened in the past: 4 justices want position A, 4 want position B, and the 9th wants something in the middle. In Heller, isn't it assumed that, while Scalia wrote the opinion, Kennedy made him restrict its scope drastically in order for him to agree to go along? So basically I'm saying I don't understand Roberts' Taney fear, as long as he is careful what he agrees to. |
