I believe she should resign, but as you stated earlier part of the function is determining if the legal criteria are met. In a sense by her signature she is giving her blessing because she is saying that same sex couples meet the legal criteria. The Supreme Court said that it does meet the legal criteria so if she won't perform her duties she should resign. |
