Jindal is only threatening the Westboros with arrest, so far...You mean he is preemptively declaring to arrest someone without any probable cause that they may be committing of a crime? He issued a summary declaration that people who conduct this kind of peaceful (if odious) protests are guilty of criminal misconduct even though the SCOTUS has already conclusively ruled it as protected free speech. What do you call such an action if not an executive bill of attainder? |
