Well, I can only hope that the CCRB closed the case because they saw this was a fairly petty argument and have other claims to work on finding out if they are substantiated or not, such as allegations of police physical misconduct.

Deleting photos is not petty. More likely its another typical CCRB cover-up of police misconduct. Nilet should go the the NYCLU instead of wasting his time in Kangaroo Courts like the CCRB!

I had luck with 7 On Your Side. Sent them an e-mail on their website and they called back two days later. (Pretty good service I would say.) I was on TV in five days. If you write a good e-mail, you can interest them. The key is to make it sound like you are not the only one being affected and how making other people aware of what happened to you will also help them. Since all you have to do is tell the truth, this shouldn't be too difficult.

I just got my final letter from the CCRB. The charges were substantiated and the CCRB will pass on the information to press charges which may result in loss of vacation, days in the street, probation, or termination. The letter specifies that this penalty is more severe than a command discipline.

Glad to have that settled. Now I'll be heading off to file a FOIA request to get my photos back. The CCRB undeleted them, but I supposedly need to file a FOIA request to get them.

JUSTICE!! I'm glad you stuck it out. Kudos to you! Hopefully this will get around the NYPD and they will implement some kind of training class on this subject for the benefit of the officers as well as railfans. Post the pictures when you get 'em back. Congratulations!

Unfortunately, harassment of legal photography will continue, and each incident must be reported and followed through, as some still may not get the message.

Don't expect anything to happen to the cop. They are completely immune to any discipline, in fact they can commit murder (Amadou Diallo, Sean Bell) or savagely beat helpless people (Rodney King) and get off scot-free.

Perhaps you missed the re-trial of the King cops, who were found guilty of a crime and sentenced to prison. The Diallo cops were acquitted by a jury and therefore not subject to punishment for committing something not considered a crime. The jury is still out on the Bell cops, but they also did nothing wrong, IMO.

On the other hand, if you read some of Jeff Rosen's posts here he occasionally boasts of the violent felonies he and his fellow police officers have committed. I don't know if he is telling the truth, and if he is I suspect the recipients of the violence were not usually nice people either, but his posts do suggest that in his personal experience police officers are above the law.

I agree some cops think they are above the law. But none in the given examples are, IMHO. Only cop-bashers and racists do.

That being said, most cops are not the polite, by the book nice guys you see on "Disordly Conduct" or "Hot Pursuit". That's the video camera effect.

Cops are human beings.

While he sure seems like a nice guy in person, his posts about accidentally breaking the camera of a person who would take his photo without permission is downright scary, and I don't see why he would make such a post if he wasn't being serious.

No! I live in NORTH Dakota!

Be that as it may, the State Police do NOT operate 24/7, but are closed down for a few hours every night when NO ONE AT ALL IS ON DUTY, but of course *are* on call.

No, Terrapin Station has the physical memory card in question. The CCRB gave the card back to me, hopefully non-overwritten, and since the camera and card were on loan from Terrapin Station, I returned the camera to him. The investigator who handled the case said that I should file a FOIA request to get the photos (and videos) back; if that fails, I'd have to borrow the card back again from Terrapin to run an undelete on it— hopefully, he'd be willing to re-loan it.

Great to hear, Glad you stuck with it. Hopefully it gets around, At least a copy of this will be in their jackets for the rest of the time there with the Police Dept.
