MTA Demands Slice of the Action at Brooklyn Bagel Shop or Else |

The MTA is within its rights since it went through the steps to copyright the bullets.As far as the owners of the bagel shop making an honest living, I can't call violating trademark/copyright laws being honest. I think there's also an E F Deli at the entrance to the 53rd St. and 5th Ave. Station (even though the E and the V stop there now). I wonder if the MTA will go after them, too. According to NYS law property acquired by the TA must be related to transit operations. They would not haven gotten into trouble if they had left off the orange disk behind the F. If it is a trademark, then the question of use and confusion comes in to play. Would the public be confused by into thinking that the bagel shop is operating a transit system? If it's a copyright, then only the expression is protected, not the underlying idea. The TA did not copyright the letter "F" or a disk. So, if the type face is different or the disk is another color then the copyright has not been infringed. Of course, if the bagel shop can find prior instances of the letter F centered on a disk, then they can invalidate the copyright. Unfortunately, the TA has a staff of lawyers and the bagel shop doesn't. Perhaps, the legal staff is trying to demonstrate its worth as a revenue center. I thought they were scheduled for elimination as part of the "close the gap" [budget] program. |

Respect for MTA depends on their dealing fairly and straight-forwardly with everyone, not looking the other way when this happens. |

I don't know if I agree. The rights the MTA has to subway line letter names and associated "bullets" are presumably limited to the use of these names in mass transit. Trademarks generally must be applied for a certain purpose only that you are in fact using. So while MTA can protect the "bullets" for mass transit uses, they can't protect them for purposes of running a bagel shop, since they are not in that business. The exception is if the public is confused by the use of the bullets for the bagel shop, into thinking that the bagel shop is part of the MTA, like maybe a station entrance. This is hardly likely in this case. So I think the MTA is overreaching, as most intellectual property owners seem to be doing these days. |

Why can't there be a Hotel Pennsylvania (named after the station -- oh wait-- there is!), or an F Line Bagels? |

And who ever describes the "F" train as the "F Line"? Secondly, the raised letter "F" on a circular background does not really resemble the MTA's bullet. In another copyright case, it was determined that "numbers" could not be copyrighted, it might have had something to due with Boeing and their 7*7 planes. Does every "Subway Sandwich Shop" pay a royalty to the MTA for their reproductions of subway maps? What actual MTA items that he purchased are on display? Certainly, you don't sign an agreement that you can't use their surplus items commercially? |

Can the MTA sue me, or can I sue the MTA as noone knows (except us railfans) that some of those letters exist on roll signs, if the MTA decides to create a new line in the future using the letter with my diamond or circle?. |
