F Line Bagels, across from the Smith & Ninth subway station bought some subway memorabilia and apparently uses the "F" logo. The MTA has warned them that the bagel shop owners are using the MTA's intellectual property without paying them tribute.

I hate to say this but the MTA is correct in this action.

Since the MTA trademarked/copyrighted the bullets, you must have permisison from them to earn money by using it.

I should have known that you would side with the all powerful MTA and their attempt to crush someone who was trying to make an honest living.

If only I knew how to get there, I,for one, would go to F Line Bagels and show my support by buying a plain bagel with a shmear. (I wonder if their lox is fresh.)

I just searched on Google and came up with someone who complained that naming the store "F Line Bagels" is yet another insult to the G train.

The "F" symbol on the sign looks quite different from what you see on the subway; even though the color may be the same, the raised letter is completely unlike the subway scheme.

It has nothing to do with my siding with the "all powerful MTA". The MTA is within its rights since it went through the steps to copyright the bullets.

As far as the owners of the bagel shop making an honest living, I can't call violating trademark/copyright laws being honest. They would not haven gotten into trouble if they had left off the orange disk behind the F.

Perhaps, but the MTA can easily show intent since it resembles the F line bullet and anyone looking at it would recognize it as such.

I think there's also an E F Deli at the entrance to the 53rd St. and 5th Ave. Station (even though the E and the V stop there now). I wonder if the MTA will go after them, too. I think they've been there a long time.

I don't see how a state authority can claim copyright or trademark infringement. Aren't we all part of the State, anyway?

Are you sure that the TA was given the power to obtain intellectual property? According to NYS law property acquired by the TA must be related to transit operations.

They would not haven gotten into trouble if they had left off the orange disk behind the F.

If it is a trademark, then the question of use and confusion comes in to play. Would the public be confused by into thinking that the bagel shop is operating a transit system?

If it's a copyright, then only the expression is protected, not the underlying idea. The TA did not copyright the letter "F" or a disk. So, if the type face is different or the disk is another color then the copyright has not been infringed. Of course, if the bagel shop can find prior instances of the letter F centered on a disk, then they can invalidate the copyright.

Unfortunately, the TA has a staff of lawyers and the bagel shop doesn't. Perhaps, the legal staff is trying to demonstrate its worth as a revenue center. I thought they were scheduled for elimination as part of the "close the gap" [budget] program.

It's probably because the MTA is technically a self-supporting entity. The US Postal Service also claims copyrights and trademarks, and like the MTA is self-supporting.

Someone would have to be smoking something funny to think this store is part of the subway station. It does remind me of a street-level subway station at 42 Street between B'way and 7 Avenue.

If the MTA F Logo helps pull in the customers, then MTA has earned a little royalty payment. The owner is obviously proud of himself that he's "getting one over" somebody, but if he's cheating MTA out of a royalty, you have to ask yourself, "Who else is he cheating?"

There's no legal reason a state or city government can't have a copyright or trademark. NY State owns the "I [heart] NY" logo, and NY City is trademarking "The world's second home."

Actually, it is a wise move on their part. This guy is stealing intellectual property. You don't realize how many people understand it. A few of his friends might support his unethical behavior but MTA's popularity does not depend on this.

If MTA allows him to do this, how many other people will be encouraged to take advantage?

Respect for MTA depends on their dealing fairly and straight-forwardly with everyone, not looking the other way when this happens.

Could the use of "W" and "E" on this strip map be construed as violation of the MTA's copyright? I saw the "E" (meaning east) but first thought it was a pointer to the E train (which we all know doesn't run to Carroll Gardens ....)

There are a whole bunch of "letters/numbers in a disk" available as fonts on the Internet. Just look at any Wingdings-style font, and also take a look at the http://www.unicode.org/ character charts for "Enclosed Alphanumerics."

It has to do with the unique combination of the letter and the color used on the disk.

A white F on a blue disk would more than likely not be a problem.

I don't know if I agree. The rights the MTA has to subway line letter names and associated "bullets" are presumably limited to the use of these names in mass transit. Trademarks generally must be applied for a certain purpose only that you are in fact using. So while MTA can protect the "bullets" for mass transit uses, they can't protect them for purposes of running a bagel shop, since they are not in that business. The exception is if the public is confused by the use of the bullets for the bagel shop, into thinking that the bagel shop is part of the MTA, like maybe a station entrance. This is hardly likely in this case. So I think the MTA is overreaching, as most intellectual property owners seem to be doing these days.

I would think that it was quite obvious that the owners of the bagel shop purposefully named their store F line and used the MTA bullet to identify with the F subway line which runs above.

That can be construed as intent to use someone elses copyright.

We can argue back and forth on this. Why not let the MTA and the Bagel guys work it out. I am sure it will make the newspaper again.

So the bagel owners named their shop after a local transit line -- big deal. Grand Central Camera is named after Grand Central Terminal. Is MTA suing them? The fact is, the transit line is a landmark. Local stores are often named after landmarks. There are plenty of Terminal Diners and Last Stop Saloons. Why can't there be a Hotel Pennsylvania (named after the station -- oh wait-- there is!), or an F Line Bagels?

Why would they? Grand Central is the accepted name of the area. But if GC Camera were to use the MTA's logo/symbol for Grand Central Terminal then they would be sued.

Agreed but they don't use the logos or symbols that are officially used by the transit agency (unless they have permission).

This instance might not be important in itself. However, there have been instances where intellectual property and copy- rights have been lost because they haven’t been adequately defended.

The “right” solution in this case might be for the Bagel shop to license the use of the F-train logo for $1.50 for 100 years. That way the status quo remains and everyone is happy.

Notice the Avenue Q logo looks similar to the 6 Ave Q bullet, not to mention a poolhall in Soho or Tribeca called the Q uses that same bullet(if the place still exists).

How is he stealing intellectual property? His F logo doesn't look very much like the MTA F logo. The courts usually rule that the imitation has to be pretty close when it comes to trademarks.

Have they sued the musical Avenue Q? No, and probably for the same reason - it's not a close enough appropriation of the logo to count.

Look at their hats and shirts. It's designed deliberatley too look like official subway apparel.

It's clear this establishment is infringing on the MTA's intellectual property rights.

And who ever describes the "F" train as the "F Line"? Secondly, the raised letter "F" on a circular background does not really resemble the MTA's bullet. In another copyright case, it was determined that "numbers" could not be copyrighted, it might have had something to due with Boeing and their 7*7 planes. Does every "Subway Sandwich Shop" pay a royalty to the MTA for their reproductions of subway maps? What actual MTA items that he purchased are on display? Certainly, you don't sign an agreement that you can't use their surplus items commercially?

Another point, I want to open the "U" or the "X" , or the "P" or the "Y" line so-so store. I create a similar logo. Can the MTA sue me, or can I sue the MTA as noone knows (except us railfans) that some of those letters exist on roll signs, if the MTA decides to create a new line in the future using the letter with my diamond or circle?.

While I think copyright law has overreached in general, those guys really stepped over the line.
