Actually, I think they've only gone so far as to post his picture in every crew room and tower. I think NYCT would need a court order to ban him from public areas of their property. |

They will raise it, but they would be wrong, for it was neither cruel nor unusual punishment at the time the constitution was written, and it is neither cruel nor unusual now.So OK... WATERBOARD them instead!

I think he can be banned from the subway, and without a court order at that. Enforcement would be a more difficult issue, but if caught on the property he can then be brought before the Transit Burro for adjudication.

IMHO, the TA would be on dubious legal grounds to charge Darius with trespassing, if they couldn't show that he was outside a public area. specific ban on a particular individual would have to be accompanied by legal documentation, and as you noted, wold be tough to enforce.I do know that when Darius has been spotted on TA property in the past, crews have notified supervision to have transit cops come down and keep an eye on him... |

There were a pair of guys that got on a plane but in their checked baggage, they had a bunch of cell phones taped together including one taped to a bottle of Pepto Bismol. It was THAT one that set off the terrorist flag and had them arrested on the other end of the flight in Amsterdam after they arrived there. Dunno HOW you can get a bottle of Pepto Bismol to explode even by heating it, but that was the panic. :) |
