Kerzic was arrested by the Amtrak police while taking pictures of a train pulling into Pennsylvania Station. At first, the police asked him to delete the images from his camera, but he refused. He ended up handcuffed to the wall of a holding cell while an officer wrote a ticket for trespassing. |

I had a similar problem at Penn Station, but I settled for a total of 8k from Amtrak and the city. When Duane Kerzic first posted about his incident (which was cross posted by an alert SubChatter) I contacted him and hooked him up with the lawyer who had represented me, Gerald Cohen. It's really cool to see the whole affair get some mention on the NY Times.Now a little bird told me how much he settled for, but I also know it was dependent on some non-disclosure terms (mentioned in the article) so I won't speculate further on a public forum. What I can say if that if you have a problem with rail photography and nobody else can help and if your trouble took place within the City of New York, maybe you can hire, Gerald Cohen. He's become sort of a subject matter expert in this and is involved in at least one more recent case. |

The Global war On Photography (GWOP) is getting waaay out of hand. I expect the growing number of rules or laws against photography (such as PATH's across-the-board ban on picture-taking in its system, or Maryland's prohibition on photographing the police) will ultimately end up in the U.S. Supreme Court as a First Amendment case. |

Yes, sadly some verdicts do come with an exemption but IINM it is dependent on the court. Though many do not realize they have to declare it as income. |

Not if they are actual damages which mine were. After the lawyer's 1/3 the settlements covered my own legal fees fighting the ticket, plus the cost of my ruined trip and loss of camera etc. Of course if I did come out ahead I am not going to go bragging about it on a public forum. |

I think he use "flash" while taking pictures.I am Japanese and in Japan, "taking pictures with flash" should be avoided because flash lights may be risk for train operators. (Operator cannot see forward of train because of flash light.) I always try not to use flash.l (If need to use it, I take picture from backward.) |
