Yes, like for here, there are cases where the 'victim' like the drunk person that lost his legs and got a few millions of dollars for his own stupidity. if the jury didn't side with him, he would not have won that much money from the MTA.
Yes I understand he'll need the money because he can't work again, but it was his own fault he lost his legs.

no. that's not how it works. they are placing blame on the defendant (or whatever the correct term is), not themselves.

Railways *are* required to fence in the ROW when the line is adjacent to a public area such as a road or a sidewalk. They are not required to do so when the line transverses open countryside or in areas away from sidewalks.

Or at least this is my understanding, although this may only be a local ordinance or something.
