NY MTA Claims SFMTA Parody Infringes on Trademarks

Apparently just selling a t-shirt with a letter in a colored circle can get you a Cease and Desist notice from the New York MTA lawyer. Someone who designed a T-shirt to parody and criticize San Francisco's MUNI system (clearly protected first amendment use) received a letter from Lester Freundlich, defender of the MTA against bagel houses, cookie shops, and postcard vendors, ordering him to cease and desist.

Story here

Is the NY MTA claiming that they now own the trademarks and/or copyrights of the SF MUNI? Is that lawyer colorblind? And finally hasn't he ever heard of fair use when it comes to parody? Has he gone totally insane?

As I remarked in another post regarding the MTA's alleged copyright of numbers and/or other symbols contained in variously colored bullets, since many transit systems and other corporations and agencies throughout the country and even the world use various letters and numbers inside circles or "bullets" and have probably done so long before the MTA, I fail to see how the MTA can even think of claiming copyright to those items.

OMG he is off his f--ing rocker! What a lameass! Mr Freundlich needs to get a grip. The colors do not correspond to MTA colors while clearly corresponding to MUNI routes. If any agency has a right to gripe it is SFMTA/MUNI not NY's MTA (Although I think SFMTA would be as dumb as NYMTA is when they gripe)

What I found so surprising about this incident is that the route symbols the guy used have nothing to do with New York's MTA. The colors are all wrong. So even if I were to concede that the MTA can protect its own route bullets - what they are doing here is way overboard.

Here the MTA lawyer is wrong on two levels - he is asserting rights over another system's route bullets and second use of trademarks for parody is permitted

Meh. That's what corporate lawyers spend much of their time doing. They don't always have to be taken seriously. If I were him I would give the letter the attention that it deserves. None. I'd bet that they won't sue and I wouldn't worry too much until they did.

The trouble is he does not manufacture the t-shirts but rather had the design for sale on Cafepress. Unfortunately whenever a lawyer says "jump", Cafepress asks "how high"...

The real problem is that the profits made from that site are miniscule and not worth hiring a lawyer to defend. I just found it hilarious that our MTA would send a letter fighting over symbols that belong to San Francisco's MTA.

MUNI appears to not be defending its trademarks as vigorously. Various souvenirs and products containing their logos and route symbols are sold. There is a lot of MUNI stuff on Cafepress and other sites. And unlike our MTA that is trying to declare copyright over raw data, SFMUNI is freely releasing its schedule information to all developers.

Well it is sad that the MTA is even browsing websites like this. Doesn't this asshole have better things to do? People are always suing MTA over torts and all that they do nothing but a guy trying to make a few small dollars on another transit agency's logos they go after. Time to bring this to the attention of our transit reporters and embarass some MTA butt

I can understand that.

Speaking of defending copyright, LACMTA doesn't seem to care at all. One railfan started a website called "LA Metro Forums" which if you didn't know better you would naturally assume that it was operated by LACMTA. But they never objected even when he invited them to become members. Unfortunately there weren't enough railfans to keep it going. I haven't been there in a while but it was dead a month or two ago.

I don't know why our MTA even bothers - the licensing program earned them a whopping $200,000, hardly enough to reduce the fare by a penny. I bet they waste that amount of more chasing after so-called infringers. And they don't get any additional licensees - the bottom line is that selling prints at train shows simply isn't that profitable. The bagel house covered over its signs rather than pay, etc. For all their efforts they have not picked up additional revenue.

I would bet then that they operate at a loss. Do you know where the NY State public servants’ pay data is? Let’s see how much old Lester (Lester G Freundlich of the cease and desist campaigns) makes. Add overhead and a couple of paeons who do the real work and I’m sure that we have half a million down the drain!

The response should warn that if a lawsuit is filed, evidence of ownership of copyright and trademark will be subpoenaed and verified against the LOC and USPTO databases (knowing that they would come up registered to MUNI, enabling that person to countersue the MTA).

I just did a search on TESS, using the address of the MTA headquarters (347 Madison Avenue) as the search term.

Seventy-five (75) entries came up, most of them are live.

MUNI has a different attitude - to them a route bullet is just a functioning label to identify the train and it is not trademarked.

And based on Marrero's (R36 #9346) findings, it should be an open-and-shut case---against the MTA; the USPTO doesn't describe the N trademark as is in the pic in the article.

No right that I can see. But here is a little disclaimer: R36 #9346 did the search under MTA @ 347 Madison. I wonder what may pop out if a search is done under each MTA Agency and each address (e.g. MTA New York City Transit - 2 Broadway, MTA New York City Transit - 130 Livingston, etc)

True. Now, 1 think I think is interesting (from my personal observations) is that SF MUNI is more photographed than NY MTA. I say this as MUNI has tourists come and make a point to photograph them for thei cable cars, and historic trolleys. NY MTA does to get photographed but not on the scale of MUNI. Could you imagine the chaos and uproar if MUNI was as aggresive as NY MTA? You know MUNI does not get applauded often but for this I do as they recognize fairness.

If the book is not published, authored and otherwise affiliated with MTA then the MTA has no right to dictate what is in the book (although the author/publisher of the book should have satisfied any copyright issuies w/MTA). Just because the NYTM sells it does not mean MTA is responsible for content.

In the Disney case there is intent in trademark/copyright violation. But here everything on the t-shirts in question is obviously intended towards SFMTA/MUNI with one the bullets being somewhat similar to NY MTA but the colors do not match at all. If you look at it overall there is NO I repeat NO real connection at all to NY MTA. This lawyer just said "bullets? That's it I'm suing!"

Exactly!! And on top of that it is a parody which courts have ruled to be permissible and do not constitute trademark infringements.

The funny thing is that if you read the blog post that I referred to in the original post, the creator of the t-shirts really believed that it was SFMTA that went after him - he has nothing to do with NY, the thought never even crossed his mind.

This is clearly a case of NY MTA's attorney being so overzealous that he is now blinded to the fact that other transit companies may in fact be using route bullets - someone should tell him that there is actually a world west of the Hudson.

A Mickey Mouse has unique features that identify it regardless of color. No-one can trademark a generic letter in a circle. What makes it unique to the MTA IS the color combination.

Also see my other posts and the court cases I cited - if you made a blue Mickey Mouse to parody Disney in some way then it would be permissible. Still the bottom line is that the NY MTA went after someone who used SFMTA bullets, which are not trademarked.
