Even if that were the case, every time the employee was denied a promotion he could bring an action that such denial was retaliatory for having prevailed in a legal action and it would then be up to the agency to prove otherwise. My father had a similar situation with the Dept of Correction in which the agency head appointed a crony to a top level position which was competitive and required an exam. My father took the case to court and the agency was forced to hold an exam and my father placed higher on the list than the hack who was holding the job provisionally and got the job. The agency didn't dare use the "one in three" rule since it would have been so patently obvious that denying my father the position would have been prima facie evidence of retaliation. Also, since the plaintiff's case has achieved media attention, the last thing the MTA would want is any more unfavorable publicity than it already has. |

Also, although the plaintiff may end up settling the suit for a much smaller amount than demanded, one of the main reasons for large monetary settlements is to severely punish the miscreants with more that just a slap on the wrist. The idea is to give a swift sure and severe kick in the butt that will not soon be forgotten. I would also like to add that in a similar position, I would also make, as part of such a lawsuit, a demand that the offending officer or officers be terminated from the PD and be denied the right to become any type of law enforcement officer or even a security guard for at least a significant period of time if not permanently. |

The standard D2 series strap is sufficiently comfortable. I've placed gaffer's tape over the Nikon lettering, both for discreetness and to give both sides of the strap a grippy surface.For my D1H, F3, and 400mm (which all arrived sans straps), I use Op/Tech's Pro Straps, which is also a beast of a strap. Never thought of using it as a whip, though. :-) |

The entire basis for his arrest was the photography. According to the New York Times article he was charged with illegal photography - that was the first thing he was charged with. The cops ordered him to stop taking pictures which is an illegal order that violates the rights granted to him by 21NYCRR1050.9c. Cities and police departments need to be repeatedly sued until they learn to treat people who carry cameras no different than those wearing a necktie. |
