Posted by NJCL2308 on Wed Apr 15 18:23:27 2009 Today, I went on a railfanning excursion to Morristown and Danbury. The train I had coming back to Long Branch, where I live, was a doubleheaded train powered by 4214 and 4141. As I recorded the train leaving, two gentlemen approached me. I will here refer to him as "Suit," since that's what he was wearing.Suit: "Hey, How ya doin?" Me: "I'm doing alright, how about you?" Suit: "I'm doing okay. What are you doing?" Me: "I'm recording." Suit: "Excuse Me?" Me: "I'm recording." Suit: "Recording what?" Me: "The train." Suit: "Why?" Me: "Because it's my hobby." -At this point, I switched the video off, which I really wish I hadn't. Suit: "Okay. Taking a video of that train isn't really allowed, since it's going through a railyard. Following 9/11, we clamped down on a lot of things of that nature." Me: "It's my understanding that Warrington issued a letter precisely to the contrary." Suit: "Well, Warrington isn't the GM anymore. It's no problem being at a station and getting a passing trains, I understand that-a lot of guys have that hobby, but certain points, such as tunnels, bridges, and yards, can not be videod or photographed anymore. Especially railyards, since it also draws unwanted attetion to employees, which is what we are. If so, what should I write without coming across as an ass. I have the first few lines on video. Up until RIGHT before he tells me I "Can't Do That." Will that be sufficient evidence? Copy of the message I sent NJT:Good evening. My name is Kurt Weber, and I live in Long Branch, New Jersey. This evening, I stepped off of train 2305 from Hoboken, which I had ridden from Hoboken, and proceeded to take a video of it, seeing as how A) I am a railfan and it is my hobby, and B) The train had two locomotives, which is a rare and newsworthy occurrence. As I recorded I was approached by two employees and instructed by one to stop what I was doing, since it was quote-unquote "illegal." However, the letter posted here (http://www.thejoekorner.com/njt-photo-ok-letter.shtm) issued by former manager George Warrington states that photography from public areas (which is where I was standing) is perfectly legal. However, the employee informed me that "since Warrington is no longer manager, the letter no longer applies." I do have a video chronicling the first few moments of the encounter, which is located here (http://www.youtube.com/watch?v=897bjr1nEuo) However, it cuts off before the employee "informed" me of this apparently contradictory policy. Additionally, he told me that "it brings unwanted attention to employees, which is what we are," I didn't not get his name or position, however I can relate to you his physical appearance: He was a sharply-dressed gentleman in a suit, tie, and coat. He had ginger-ish hair and stood about 5-8. He was accompanied by another man. I had previously seen both men get on the train at the MMC employee stop.The other employee remained silent throughout the encounter Following the "encounter" they both proceeded into the railyard, and, presumably, to the yard office. The same thing happened to me twice last year.Once I was at the 125th St Station of Metro North, and 2 MTA Cops came over to me, and asked what I was doing. I told him that I was a railfan, just got off the train from Marble Hill, and was shooting videos as my hobby. I told him in 50 years nobody has ever stopped me. He said that some of the employees aboard the trains felt uncomfortable.I asked him since when is it against the law, he said it wasn't but he saw the videos and said ok, In 20 minutes he came back, and I told him I was leaving. A few months later I was at Harrison on PATH and a PATH Motorman, said I am not allowed to take pictures, I asked since when, but he left. 5 minutes later (It was rush hours) 2 PA Cops got off the next train and I asked them the same question, since when is it against the law, and they said it was not, but against the rules. I was not going to argue with them, so I left.since I only had a 4 hour layover at EWR between flights. I have been taking pictures at both places since I was a kid in the 50s and this never happened before. What ever happened to freedom of the press. Maybe unde Obama, things will change |

You can be at a station taking photos, videos and whatnot and the next thing you know, you have some authority breathing down your neck and busting chops. That's why I don't photograph there very much but the difference is when I do photograph, I'm either at the train station or on the train itself. I'm not trespassing on railroad property. IDK WHAT their problem is whatsoever but I see nothing wrong with that video you posted. It was taken at a train station...NOT at a train yard. What's this stunad smoking?If I were you, I'd report the incident to the ACLU. If they can resolve the issue with the NYPD, then they can get this straightened out as well. |

Then again, maybe the train stopped --at-- the yard to pick up these employee blokes and he had the camera pointed TOWARDS the yard for the 2 or 3 minutes it took for these blockheads to get on-board fully. (I can understand panning a shot past the yard, but if he's got the camera pointed AT the yard the whole time it took to board these guys, and they seen it, then ok they can be curious but HELLA NO dont be claiming a policy which is null and void). |

The problem is that NJT Customer Service tells photographers that they are free to take pictures of any publicly accessible area. They do not qualify it in any way.NJT made a promise to the NJCLU and Railpace during the Warrington years? Are they reneging on that promise now? Is their word meaningless? I think someone should call NJT and record the conversation with customer service - then record an encounter they have with an NJT employee. Make a video overlaying NJT customer service and the crap they get from the NJT police or employee and post it on YouTube and send links to the press and the NJCLU. Make NJT eat its words and publicly embarrass them!!! Maybe that will be one of my projects this summer! |

The blokes got on the train right after I did, and got off that the same stop as me, which is where I was harassed. They were already walking that way (towards the yard) and saw me. The train was still leaving as the encounter began. That's how I got a piece of his voice on the end of the video.The video wasn't even really directed at the yard; it was directed at the train. The only piece of the yard really visible is the catenary poles. |

Then under those conditions, I've been loitering for years. One of my favorite pastimes is to hang out on the platform of LIRR stations with crossing gates, locals and expresses, and a mix of equipment during rush hours. New Hyde Park and Mineola are the foremost examples. Hanging out at the Jamaica outbound platforms during PM rush is also fun. No one has ever asked to see my ticket.There are also people meeting people coming off arriving trains. They'll wait on the platform and wave for the person disembarking. It's quite comforting if this person is new to the area. Likewise, you might wait on the platform with someone you're putting on the next arriving train- especially if it's at night. If you're doing these things, you generally wouldn't have a ticket because YOU'RE not getting on or off the train. Does that constitute loitering? The only time I was ever challenged was back in 1978 during my phase of photographing LIRR trains going through street crossings. I'd done this from the street at Little Neck, NHP and Albertson with no problems. Then one day on Woodmere Boulevard, some old guy walking a dog demanded to know why I just took a picture of that train. My explanation that I was interested in trains and liked to photograph them at crossings seemed to arouse much suspicion in him. WHY would I be interested? WHY would I like to do this? Mind you, this was 23 years before terrorism-driven paranoia became an issue. |

Yeh, ok but I'd be more concerned if the revenue train had stopped at MMS (or whatever the Meadowlands Rail Facility) on-the-way-to-NWK is called... geese trains normally stopover to pick up employees there and the whole time (2-3 mins) a sitting geese has FULL VIEW facing teh yard complex while the C/R boards the waiting yard staff... --THIS-- is what I thought you meant till I saw yer video.... you really dont' even *see* any yard in your shot (so I dont see offence). I thought you were saying they got on from the Rail Facility and saw you pointing yer camera INTO teh yard (which is not more than 30 feet at that location). Hence, I said nevermind, brah. |
