On Mondays I'd have to supervise a batch distribution so I needed to be at work by 6AM. The way I worked it out I was at work by 5:30AM, and if I missed my connection at the airport bus terminal to continue south, the next bus would still get me to work on time. I two years Iwasnever late. Not once. Shit happens to the unprepared. After that, you're either prepared or you're not. That's the difference between an adult and an adolescent. |

Walking in between cars is not dangerous, if they are holding on to the grab-irons in between cars. I've seen too many people who don't hold on or hold on to the safety chains (a no no) and sort of hop as they cross.Yet there still haven't been any documented recent cases of deaths resulting from people simply walking between cars. Furthermore, as you rode the museum train, you know that... There is the potential for injury here. As there is for crossing a street. Not looking both ways before crossing a street is like crossing between cars without using the handgrabs. |

I was indeed very guilty of this infraction yesterday as I went from north motor to south motor on the "C" train as I rode from Jay Street to Penn Station. I always use the grab irons and if I am in doubt, I wait, then move whilst stopped at the station. For cars with no grab irons (R40 and R40M "B" ends), I go round the outside.BTW someone became a 12-9 (and survived) on the "J" today, falling between R42s #4814 and #4815. This was on the 6PM Channel 7 news. I wonder if they were crossing between cars. wayne |

And it probably obvious that an elderly man with deteriorated motor skills should not have been walking between cars. That was a poor judgment call on his part. If one is at the front of a car, there is no need to make a "mad dash" on the platform to reach the first door of the next car. Well lets see, Boston does 65mph on level track, Philly does 70mph on level track, San Fran does 80, and Chicago has done upwards of 60 with what amount to trolley cars. Even HBLRT puts the NYC subway to shame, they top 55mph on the sections down to Bayonne. Instead NYC is so damn worried about lawsuits and has so little faith in their operators that their trains are lucky to reach 50mph at the bottom of a cross-river tunnel. |

Well obviously if one holds onto the handle bars on the cars then it should be safe. I have crossed b/w cars in the past even when they were moving and always had no problems.But since the MTA is more or less a bureaucracy, sadly the MTA feels they have to enforce such a rule on everyone regardless of if the person can cross safely or not all. This is all so that they won't be sued by the one person out of maybe 50-100 that do cross safely. |

I doubt the statistics help NYCT's case since they have never provided them, AFAIK, and when making the case for prohibiting walking between cars, they had to lie and show a video of 75' cars making a turn and saying how dangerous that was and that's why it needs to be banned. And as was stated, at least 5 of the 14 recent (pre-the new law) cases of between the cars 12-9's were due to people riding between cars, not just walking between cars. |

The real solution is to amend the CPLR to impose a high bar to clear to for negligence actions (maybe gross negligence has to be shown) and also a cap on total damages, with a provision that lets the state ask for attorney's fees if the plaintiff didn't make out his prima facie case.Fat chance of that ever happening.... |
