LOL Told ya so!

Scene: Northbound (J) train on a Saturday evening.
Where: Krotchpeealso Street

As we're leaving the station, I was standing outside my cab, and an otherwise nice lady approached me, looking to walk between cars. (She had just crossed into my car from the other end.) She first innocently asks me, "Sir, does this train stop at Broadway Junction?"

"Yes ma'am, it does."

"Oh, thank you!!"

She then walks right up to me and almost tries to reach around me to get to the storm door. I just stare at her. She backs up, and says, "I can't cross through?"

"No ma'am, it's against the law."

"Oh! Thank you so much." She smiles and stands next to the doors, so she can use the platform at Gates Avenue to get to the next car.

Sure enough, she runs to the next car at Gates, and then proceeds to continue making her way between cars towards the front of the train.

At Chauncey Street, two cops pull her off the train. Judging by the length of time the cops held me in the station in order to get her off the train, she must've put up quite a resistance. When they finally coaxed her off, and we were pulling out of the station, I could see she was not happy at all. One stop away...oh so close!! LOL

Even if the cops decided to be nice and not ticket her, at the very least, she had to wait ten minutes for the next train.

Live and learn, eh?

Were these uniform cops that pulled her off...or did she think the officers were impostors (but turned out to be real)...in other words, plainclothes? The resistance may have ended up leading to an arrest.

Now, if she claimed she couldn't walk all the way to the stairs from the back of the train, the police could simply say that she should not be riding the subway, and have considered a bus instead.

Unless you're riding the #1 to South Ferry in the next year or so, there's no need for anyone to move from whatever car they boarded the train on, unless you're trying to get away from potential muggers, loud drunks, smelly homeless people or a hot car in the summertime.

Duh, that's how criminals steal property.

They snatch a purse inside a train and jump out between cars as the doors close but before the train moves. Or they scan from car to car, looking for the perfect target.

Or, this is a good deterrent to a possible 12-9.

They took her off for her own good, possibly preventing her from being the victim of a crime or injury at some other future time. And yes, they do indeed go after real criminals too. Many times they pick up criminals with outstanding warrants when they commit low level offenses. Remember the case of the Russian dentist being killed in front of his daughter in Forest Hills recently? The got the suspect in his killing over fingerprints taken during a fare evasion arrest.

I'm not going to lie. I often pass between cars. At Jamaica Center the main entrance leaves you at the back of the E train. However, in order to catch the 6 I need to be in the front. After making sure that there aren't cops around I pass through. Instead of creating a police state cops should be focused on muggers and people who litter.

That is the typical reaction of a person who does something illegal, no matter how mundane the offense is. I'm sure there are kids who steal the perverbial apple from the fruit and vegetable display, don't get caught, then later in life go on for "bigger and better things" because they were never caught for the first offense. Let the cops summons the other guy for the other stuff. Yes, they should give out summons' for littering too, and the street cops should give out summons' for jay-walking also. Let me remind you there are plain clothes cops around waiting for you to move in between cars. Don't "cry" to us when it happens. It may not happen this month or this year, but guarantee if you keep it up, your odds of getting caught at a certain point will increase.

"However, in order to catch the 6 I need to be in the front."

False statement. You can be anywhere on the train. In order to catch the 6 train you need only arrive at the proper station. If you arrive at 53rd/Lex at the rear of the train, you will merely need to walk the length of the platform to the proper escalator. Given the high frequency of 6 trains, youwill not suffer any terrible consequences.

Alternatively, you can walk toward the front of the E train and then board, or you can take an earlier E train so you arrive at 53rd/Lex earlier.

You have no "need" to pass through the cars; this is merely impulsive behavior. You can choose to exercise self-discipline and not do it.

Walking in between cars is not dangerous, if they are holding on to the grab-irons in between cars. I've seen too many people who don't hold on or hold on to the safety chains (a no no) and sort of hop as they cross. These are the people being targeted, this is the reason why the rule was made, because in grade school one bad kid causes the whole class to be punished, in TA worker regulations a new rule, and in passenger
responsibility new rules for all. There is the potential for injury here. Because of the later, the law was made. Obviously you don't agree with this law. That's OK.

If they never were allowed to cross in between cars, then they would have never thought about riding in between cars at a later time. People have been killed riding in between cars, people have been killed crossing in between cars, If more people get killed riding in between cars, losing their balance and falling, than people crossing in between cars, then we should allow them to cross since less accidents occur?

I grew up in an era when the storm doors were left open for the entire length of the train - and/or articulated cars still roamed the rails. It is very hard to give up that freedom of motion.

Another problem is that they say you can move in the event of a critical situation such as being harassed, etc. That exception is very subjective. I find indoor temperatures above 70 degrees to be physically intolerable so if a car's air conditioner is not functioning at peak capacity I need to find one that is. Other people can take the heat or for that matter even like it...

At least in the pre-a/c days I could open the windows wide open and stand next to an open storm door and let the wind blow in my face as the train ran... Even better were the railfan windows that had a sash that opened :-D

Either crossing or riding can be hazardous behavior. They have to make blanket rules to have real enforcement. As always with these safety rules, if police are overzealous, then it will negatively impact on them and possibly even result in the regulation being stricken by a court either as applied or prima facie, e.g., if police issued summonses without regard to whether or not a passenger crossed between cars in order to get away from dangerous/unpleasant conditions then they obviously could not be trusted with the discretion vested in them.

I am in my mid 50's so I remember the old cars with the storm doors open and being able to cross between cars. If a cop is on a train patrolling and sees a whole bunch of geese crossing cars one after another to get away from a negative situation, he's not going to be that stupid to round everybody up an start giving out summons'.

The problem is that it is still subjective - some people are more tolerant of negative situations than others. I tend to be very intolerant when it comes to temperature - other people just stay in hot cars....

Should the police ticket people for crossing streets because it could prevent them from future injury?

They should definitely ticket someone when they see them doing something dangerous. Jaywalking is illegal, but given that NYC cops don't write very many jaywalking tickets they obviously have a lot of discretion.

And in those scenarios, police should recognize walking between the cars to get away as an emergency and therefore not ticket.

That's because most everybody in NYC jaywalks. Do you think that one cop is going to stop about 15-20 people and hand out tickets for it?
