What purpose does recovering the pictures serve, IF THEY ARE NOT GIVING THEM BACK OVER to you??? I'd much rather they'd find the recording of the badges and make administrative moves upon evidence... but figgers, that's asking t00 much.

The first recording of the badge numbers was deleted. Recovering it proves that the deletion event happened after I first met them, though obviously before they left completely, disproving their potential claim that I'd deleted the pictures before I met them or something. Of course, the undeletion program just picked up everything that was on the card.

Also, they might give them back. I need to talk to the supervisors.

But if he is successful, the legal fess and associated costs are recoverable by law. In fact according to a US Suprenme Court decision from sometime in the late 1970s, in a civil rights suit, reasonable and customary attorney's fees are also recoverable.

Well, if I filed a suit at all, it would be in small claims court, which has a filing fee of $15 and doesn't involve lawyers most of the time. (If I need a lawyer, I could ask a family member, perhaps; we've got a ton of lawyers in the family, though none are in the right area of law.) In any case, I'd be suing the cop responsible for the deletion, not the city, since the cop was, well, responsible for the deletion. It's not like she'd be unable to pay $30 (or $45, if I also try to recover the filing fee), and it wouldn't cause bankruptcy or anything. I can afford $15, and if I win, she can afford $30 or $45.

I don't know how handy the software would be in general, though, since I'm utterly paranoid about accidentally deleting something, and have been known to octuple-check what I have on my computer under differing conditions just to be sure nothing's being lost.

As I said in a non-necropost in a more recent thread, I saw my cousin in person for the first time since the incident last April. She's a retired cop and also worked on the CCRB before it became all-civilian (and helped teach them cop terminology and procedures afterwards). She said it could take 18 months before this case is resolved, so I guess I'll be waiting another year. :(

I also spoke with Investigator Cody about a week ago. (So this update's a week late. Sorry.) He'd said I was to expect a letter which I didn't get; when I called him about this, he said that the letter was to be expected some time after the case was closed. As my cousin hinted, that might be another year. I also asked about whether they could release the deleted photos that they recovered. Unfortunately, Mr. Cody said that I'd need to submit some weird application of some sort, and that officially, he can't even say they recovered anything, although I can guess they have something. I got the memory card back some time ago, but I still don't have the pictures.

Updates will continue to be posted if anything actually happens. Unless people get bored with this or something.

Yeah, it's a many-months-old necropost, but it's regarding the same topic, so it kinda belongs in the same thread. This topic isn't quite up to internet speed, though.

Anyway, I have no additional news regarding whether or not the cops who deleted all the photos and such will be held responsible for their actions. However, I have an update regarding the recovery of the photos themselves.

I called Investigator Cody about whether or not I could have the photos back. Mr. Cody said that he couldn't officially tell me whether they even recovered anything at all due to strict nondisclosure rules for open investigations. Making the educated guess that they had something (given that the memory card was not reformatted and only barely overwritten), I asked whether I could get the photos. At first, he was unsure; the nondisclosure rules are very strict about the release of evidence in investigations, but the photos were my property and technically available to me by running an undelete of my own.

Eventually, Mr. Cody said that he couldn't give me the photos that were undeleted from the memory card, and that if I wanted them, I would have to file a Freedom of Information Act (FOIA) request. This is annoying.

Given that very little seems to be happening regarding the CCRB (at least as far as I can tell), I'm starting to give more consideration to suing the cops and/or the police department. I'd have to consult with a lawyer, of course, though.

Even if it's unlikely that I'd be able to win much of a case, it might be worthwhile to sue anyway because filing a suit would allow me to subpoena things that would be useful as evidence, such as the cops' record books/incident reports from our "encounter" and - perhaps - the photos the CCRB is disinclined to release.

In any case, Terrapin, please don't overwrite the memory card for now. I'll let you borrow one of my cards if you really need the space.

Nilet,don't give up. It is quite obvious that you are being stone-walled.

It would be in your best interest to bring suit, naming the NYPD, City Of NY,and the MTA as defendants.

This will force their hand, and if you are sucsessful (most likely they settle out of Court), this will lead to new protocols in dealing with handling of civilian complaints in the future.

This has to be addressed. Consult an attorney as soon as possible.

Cut your losses and get on with life.
Of course *someone* needs to stand up to this STOOPITITY, and if he is willing to do so he certainly has my (moral) support. Mayhap if I lived in the city, and had money of my own, I might find some other support to lend to his cause as well.

It is not a matter of "Republicanism" which supports the independence, dignity and sovereignty of the individual.

LOL! Once again you confuse the issue with facts. Typical liberal spew.

The overwhelming majority of Senators and Congressmen voted to pass the Patriot Act. There were 98 senators who voted "yea". The Democrat most likely to be the party nominee for President in 2008 (Hillary) voted "yea."

In the House, there were 357 congressmen who voted "yea" (211 Republicans and 145 Democrats) and 62 who voted "nay" (3 Republicans and 67 Democrats).

Why not? We need more people like Nilet who will file complaints and lawsuits every time a cop harasses them for photography. Only when the cost to the municipality of harassing photographers exceeds any benefit gained will the harassment stop!!

He was an astute businessman - he was at the right place at the right time and knew how to make deals. IIRC MS-DOS which started it all was not even his invention - he knew IBM was working on a personal computer and provided an operating system he purchased from someone else. In fact the person who created the OS only got a fixed price from Gates for it - the actual inventor never profited from its subsequent success.

Not only that, but Bill Gates did not want to do the OS, and reffered IBM to someone else. When those people stood up the IBM people, they came BACK to Bill Gates, and so he acquired the rights (non-exclusive at first) did some work on it and sold it to IBM.

Think of it: If they did not come back to Bill, we might all be using the CP/M system.

In fact the person who created the OS only got a fixed price from Gates for it - the actual inventor never profited from its subsequent success.

Supposedly. What I've seen of "liberals" is highly non-unified. Would you have called Theodore Roosevelt a liberal, due to his pro-union and anti-business corruption stance?

Atheists seem to be stereotypes as "liberal;" I guess, since the Republicans hate atheists.

That's a highly generalized statement.

Considering that UNIX was being used, and what PARC had already developed, we might have been much better off if Microsoft never got into the OS business.

How do you separate that from the rich becoming greedier? Not to mention, how do you reconcile that with Matthew 19:21 and Mark 10:21?

Are you saying that riches materialize spontaneously, so that everyone can get richer perpetually? The rich get richer by snatching riches away from the poorer; this is how it's worked during the whole human existence. Please reconcile that with the verses mentioned above.

He sold the product to someone else. He asked and received a price. If he can make a silk purse out of a sow's ear, than it is his affair.

Microsoft buys a lot of properties to incorporate into their products. You see a good Idea, and you want it for yourself, you buy the company.

That *is* how PRR acquired the LIRR and thus built tunnels from Sunnyside to NYP.
