BNSF challenges Oklahoma grade-crossing law

BNSF Railway Co. is challenging in federal court an Oklahoma law that requires railroads operating in the state to minimize blocking grade crossings for longer than 10 minutes without good reason, an Oklahoma newspaper reported today.

The suit, which the Class I filed yesterday in Oklahoma City, targets Oklahoma's elected corporation commissioners and two cities' police departments that have cited the railroad for violations so far, The Oklahoman reported.

BNSF asserts that railroad operations are governed by federal agencies.

Exactly what I said the issue was in the other thread when so many were discussing whether or not the RR ROW is private property, which has nothing to do with whether or not the law is allowed.

We're actually rather spoiled around here with all the grade separation. Zillions of small and medium towns where the country's freight passes through can't afford to build that, don't have the pull to demand that but do get tied up by 2 mile long freights which may be derping along at 35mph. If the thing stops or backs up for some reason, they can't just go a few avenues over to bypass it.

true enough. I support the individual state's right to regulate such behavior. that said, the carloads of legal nonsense we are likely to see will be entertaining in its own right.

100 car freight trains go by here at 55-60 mph, and are cl;ear of the crossing in two minutes. There are not too many two mile long trains out here since there are not that many two mile long passing sidings.

We could run a two or even three mile long train east bound, but it would have to be broken up in to tow or three separate west bound trains, and they would be taking a lot of sidings.

Trains do not piddle along at 30 mph unless the have to.

No such right exists. The Guarantee Clause is violated if a republican form of government turns socialistic.
