If he "outlawed" as in worked the maximum allowable hours in a 24hr period, informed the supervisor of that, and still moved the train & there was an incident, they'd hang his ass out to dry. The supervisor who ordered him to make the move might go down too. |

Hours-of-Service is a very serious business. Even on our class III short line tourist RR we take that very seriously.If that operator did really time out, his/her refusal to move the train was totally by the book. Kudos to him/her. |

Dead on hours and shift being over are two different things.Sound to me like the operator refused operate the train because he didn't want to work beyond the time he was scheduled to work. Especially since if hours of service limits are close to being reached, he is supposed to call in advance on the radio to his control center, or notify his dispatcher before he started the move.NYCT has strict limits on this issue. |

When a operator goes over 12 hours, management will try to blame him/her for it.I have a friend at PATH who almost went beyond 12 hours one night because something happened during his extra shift that delayed him. He was concerned ... I'll not say more about it. |

But honestly, we don't have a full picture of what happened. What are WMATA rules on this subject? Were they going to be paid for the extra time? No hourly worker can be reasonably expected to work for free as a general rule. Maybe the worker has somewhere to be, like picking up a child at a school and can not work late. Maybe a supervisor is a by the book a-hole who likes to point out every rule no matter how trivial, and got it paid back. Maybe the worker is a "problem child" who lives to cause problems and should be weeded out. Truth is, we don't know and should probably reserve judgement until we know more. |

As far as workers having somewhere to be, upon hiring, employees in certain fields like transportation are advised that they may be required to work overtime due to emergencies and other unforeseen conditions so that excuse won’t fly. |

Everyone should respect true emergency situations. Supervisors or managers are known to create emergencies through their own ineptitude or to browbeat people into fixing a situation that should not have occured in the first place. You need to know your people and what there situations are to be an effective manager. |

It depends with NYCT you are supposed advice supervision when your hours of service is about to be up at least an hr or two bf the fact. At that point supervision can make plans to relieve you bc esp when there's a change in shift with dispatchers sometimes they just don't know. I wonder if the T/O did in fact reach his hrs of service limit if he or she did this. If so then its definetly on supervision and don't fault the T/O one bit. |

I'd gladly throw a couple of managers in the cab in that case and see how many homeballs they can hit. (grin) |

This NTSB report (scroll down to page 43) states that the FTA does not have an hours of service regulation and that the FRA, FAA and FMCSA do. The report criticizes Metro for allowing train operators to work up to 16 hours with only 8 hours rest time between shifts. |
