So how does this happen?

The driver sounds credible, he was sober, he was trying to provide a smooth ride for the people on the trailer. There's no reason to think he was trying to beat the train. The NTSB says the signals were working.

How do normal people like this just not notice that there's a train coming?

People can be so focused on one thing they can completely miss something else. Plus it was noisy, with loud horns, so he probably put in extra effort to block out anything not relevant to his subject.

And the Ambulance Chaser says, "five or 10 seconds earlier, then the accident wouldn't have happened." I hate lawyers like this one.
