Arrested For Dancing On Subway Platform, Couple Sues NYPD

This couple is suing after being arrested and locked up for 'impeding the flow of traffic', disorderly conduct, and one of them was cited for not having proper ID.
Of course, there's the "contempt of cop" angle--when they tried to film their encounter with the cops, the cops radioed for backup, and they were hauled off to jail, adding "resisting arrest" to their other charges--all for dancing to a steel-drum band on the platform!

Although all charges were later dropped, the couple filed a federal lawsuit against the city.

Moral: Do not test the authority of the police, because they can--and WILL--make your life difficult. During my time in EMS, I watched cops come up with all kinds of creative ways to charge people with things. There are LOTS of "catch-all" offenses with very, very broad definitions, that can be used to lock up anyone for virtually any reason.

Freedom in NYC is a very ephemeral thing.

I agree. And the money should come out of the police budget and therefore reduce coverage in the precincts where the police are not supported anyway.

According to the article about the couple's lawsuit, which was in today's online Post, the incident itself occurred last year around midnight during the Jazz At Lincoln Center Midsummer Night's Swing festival, which was held on from July 14-16. According toi the plaintiffs, the platform on which they were dancing was virtually empty. However, there is an item in the NYCT Rules Of Conduct prohibiting the "obstruction of free movement".

I see people "obstruct free movement" every day in the subway, as when they stop dead in their tracks at the tops and bottom of staircases and/or escalators, and immediately after exiting a train, as if they've never seen that particular station before...but I've never seen anyone thrown in jail for it, which is why I'm guessing there is a "contempt of cop" element to this story.

The NYPD enjoys community support in each of the city's 76 precincts, just not from the ENTIRE community. Incidents like the one described in the OP don't do anything to mitigate the image of some cops as astonishingly heavy-handed.

I still believe that if the city is sued because of the actions of the police, if the courts rule against the city, the costs should come out of the police budget. If then, the police force has to make cuts because of its own improper conduct, then the cuts should be made in areas where police are viewed least favorably.

You're probably right. But then, I've seen cops turn a violation into a felony just by the way they did verbal judo with the person they were dealing with. Jeff Rosen once posted here that he would lock up anyone who cursed at him, and that the definition of "disorderly conduct" is very broad.

What I think he was getting at, is that you WILL lose if you challenge a cop's authority, or even if the cop THINKS he's being challenged.

In my mind, they should sue and they should win.

The officer(s) found to be at fault should have to pay the entire settlement and be fired. Neither other cops nor public safety should suffer due to their actions.

We all know that there are some cops who will sometimes over-react to a given situation - and that over-reaction may not have to do with the incident at hand. I just think that discretion is the better part of valor and once you are arrested, right or wrong, you are at a disadvantage.

yes..thats a VERY good question..and Id love to hear his explaination for that very off the cuff statement.

My view of police has always been less than stellar,due to the various encounters with some racist bitches wearing/hiding behind that uniform..some with very bad attitudes..

I say..send the "white cops" to WHITE NEIGHBORHOODS..and likewise send people of color to police their own..since they obliviously don't know HOW to deal..

The point is some cops are down right ARROGANT about the power they possess over the public. Alot of times it really goes to their heads and the professionalism goes right out the window. Just the other day at night, I was traveling in my car minding my own business when I see a dark car with dark tinted windows. The car didn't new either so I never would figure it was a cop car. The cop pulled up next to me cause he felt I didn't let him go by as the street was narrow. He was pissed they I decided to play "chicken" as he called it. How the fuck was I to know who they people are driving a dark car with tinted windows? I am not a mind reader nor do I have x-ray vision. There was total lack of professionalism here.

NYPD cops have more stringent summons quotas than they did, years ago. The City is turning them into glorified meter maids, so it can earn more revenue. You are used to see this down South, not here!

Not so...I've come across a few "bad cops" who were people of color..once not too long ago sitting on my steps inside my gate of my home wanting to know why I was outside in my pajamas..!

"Take your ass in the house,put some real clothing on,get off my fucking street" does not sound like someone I'd want walking in my neighborhood carrying a firearm,with arrest powers.

How is dancing a violation of any rules? They were charged with "obstructing" the platform, but they were NOT obstructing it. The charges were dropped, because it was clear there was no case.

True enough. This part of why we rebelled against Great Britain (see Amendments 3, 4, & 5). At the same time, I;d rather avoid arrest, and file a complaint later....but that's just me.

I prefer sanity. "The taxpayers should make them rich" is hardly a rational statement. People should be made whole if there are damages. The fucking civil courts should not be a lottery. Where is making these people "rich" even remotely justified - even based on the one-sided version of the story we are privy to? We are the tax-payers. That includes you. Do you want your taxes to go for services or to pay for outrageous lawsuits? Are you willing to live without municipal water so these people can be paid? Or maybe fire protection for a year?
