MTA Subway Conductor Accused Of Punching Passenger Pleads GUILTY

A MTA conductor accused of punching a passenger on a subway in Queens in January pled guilty to assault Thursday.

Investigators said Thomas Christopher hit 18-year-old Zaid al-Doori after arguing with the teen for having his feet on a seat in an R train near the 36th Street station in Long Island City.

Under the deal, Christopher will have to attend 12 weeks of anger management classes.

He could also face disciplinary charges from the MTA.

It is unknown if he'll be able to keep his job.

If he paid into tier 4, he doesn't lose it. He loses value at age 60 because he didn't finish out his time. Tier 1 fired employees were in more of a position to lose everything. Most of the ones I have seen were given choices to resign and avoid that predicament

Termination for "cause" results in the person getting a refund of monies paid into the pension fund. He gets fired, he loses his pass, AND his pension. MTA is NOT going to carry a terminated employee to pay out ANY pension money in the future, because the terminated party has NO future with MTA, except as a fare paying passenger.

If you are fired before you become vested then the contributions are refunded. Once you become vested, however, you cannot lose your pension. There are some very significant & complex rule changes that take place if you do not complete your minimum 25 years of service and if you are under age 55 when you are terminated or resign. In some cases, your pension is even reduced by 1/2 of your social security when you begin to collect.

A friend retired after 21 years of service against advice. He was dropped from Tier IV to Tier III (the plan he was hired under) and was given 1 2/3% per year of service instead of 2% for 21 years, then when he began to collect social security, his pension was reduced another $700/month.

Its not about carrying, its about SERVICE TIME. The employee paid that time, not the TA. If as TD said the employee is vested, he does NOT lose that money. He can NOT get a refund of said money if he is vested, only a reduced payout by the retirement age. He might be able to take a full loan and pay taxes if he makes the trip to NYCERS before he goes to Livingston STreet to turn in his tools. If a 25/55 person gets fired, he reverts to 30/62 in which he receives payments at 62 with the reduced funds according to the years he would have needed. That is NYCERS law, not the TA's opinion. Only a Tier 1 can lose everything since he pays nothing out of his own pocket.
