A Brooklyn woman who got a $50 summons for resting a sore leg on a subway seat beat the ticket in court on Wednesday.

Kate Wilson, 30, an administrative assistant who lives in Sunset Park, triumphantly wielded the judge’s ruling that found her “credible” and dismissed the fine.

Wilson said she told the court her leg, injured in a race, was barely covering the corner of a D-train seat in a nearly empty subway car when an officer saw her in March.

The ticket said she had her feet on the seat — but Wilson said a second officer who wrote the ticket never even saw her.

“She didn’t even show up until a couple of minutes later [and\] I was standing,” Wilson said.

She said she was glad she didn’t have to pay the fine but annoyed that the NYPD would hassle straphangers for something so silly.

“Why would they be wasting their time doing this?” she said. “Aren’t they supposed to be helping people? Don’t they want to make the city an easier place to live?”

More than 7,000 tickets for obstructing seating were given out in 2011.

Good for her!!! I don't condone bad behavior- but it seems to me she did nothing wrong here.

If the MTA wants money just raise the fare or let people buy annual foot resting permits.

She did admit she put her foot on the corner of the seat. Very likely she got off because the officer who wrote the ticket was not there and could not be cross examined under oath or the witness officer became heresay. She just got lucky.

That's comon to have one officer write a ticket - - on behalf of another officer who is part of the same group when a person is stopped for a transit violation.

*Actually, cutting the NYPD budget would be a bad idea in light of the fact that NYPD officers are grossly underpaid. However, actions like this send the wrong message to the public.

No, they need to stop telling cops to meet quotas and harassing people taking pics and to do their jobs like targeting thieves stealing phones and such from people.

Yes. Too bad that headphone slasher didnt have his ear tickled by an NYPD Glock. Common sense in establishing policing priorities will result in better police-community relations.

Right, and if the subway car was nearly empty as described, who was she hurting? It would be another story if the car were full and another straphanger was prevented from sitting.
