AN OUTRAGED Brooklyn woman has vowed to fight a $50 summons for resting her injured leg on a seat in a nearly empty subway car.

Kate Wilson, 29, said she was nursing a strained calf muscle and propped her right leg up on an empty seat while riding the D train in Borough Park about 1 a.m. Sunday.

The car was sprinkled with about five straphangers, she said, when three cops told her to step off the train at the 36th St. station, just one stop from her home.

“There were empty seats all around the whole car,” she said. “It was ridiculous. It wasn’t a conversation. I felt harassed.”

As one cop began to write her a summons for obstructing seating, Wilson tried to reason with the officers and told them she ran 4 miles through Prospect Park the day before.

“I told them that I had run a race and my leg had been injured,” she said. “But, no, they didn’t care.”

She continued to protest until the officers told her she should “be grateful” she wasn’t getting cuffed, she recalled.

“I asked them if they had bigger fish to fry,” she recalled. “The police officer said, ‘Yeah, but we’re frying this one now.’ ”

Wilson, who works as an administrative assistant in the city, said she finally just bit her lip.

“It was a waste of resources,” she said. “I can’t help but believe this is happening to other people, but nobody comes forward.”

The NYPD didn’t respond to requests for comment.

“It’s not that [the cops\] are bad people,” Wilson said. “It’s just that they shouldn’t be robots.”

The most recent NYPD statistics show that summons activity has declined in Transit District 34, which covers the area where Wilson was caught. Tickets for occupying more than one seat are down more than 23% from the same period last year, the stats show.

After getting the ticket, Wilson said it was too late to wait for another train, so she walked several blocks home.

“I walked away with a $50 ticket and didn’t see a single cop along the streets to my home,” she said. “Three cops on the platform and no cops on the street.”

Wilson is due in court on March 27.

so in court she can prove if the leg was really injured or if she just made up the story.
Cops are not suppose to take excuses for wrong doings, they are there to enforce the law as writen, not as interpreted.

NYCRR 1050.7
Disorderly Conduct
No person on or in any facility or conveyance shall:
10. (1) occupy more than one seat on a station, platform or conveyance when to do so would interfere or tend to interfere with the operation of the Authority's transit system or the comfort of other passengers;
(2) place his or her foot on a seat on a station, platform or conveyance;

(3) lie on the floor, platform, stairway, landing or conveyance; or
(4) block free movement on a station, stairway, platform or conveyance.

IF the summons is written for occupying more than one seat like the person said, it can technically be overturned actually, since the comfort of other passengers was a non-factor, and I doubt very much that her putting her foot on a seat would interfere with a train's operation.

But since she also placed her foot on a seat (which is not allowed as per paragraph 2), her results could vary.

She has some ground to fight the ticket, but IDK if the kangaroo court can overturn a techicality...

She put her foot ON the seat of a conveyance in violation of section 2. No technicality involved. If she had stepped in dog poo (as Mike Rowe says) or mud, or some other foreign matter and the next person to occupy that seat was someone coming home from the prom, or a nice night out and sat in it, who gets the $50 cleaning bill?

The officer writes the ticket, the judge interprets the circumstances and renders a judgment.

As for the sleeping stinking bums, perhaps if an officer saw one of these he would go to a different car to. Do you know how much trouble it is to round those creatures up? You cannot just give them a ticket, but you have to take them in and ruin a perfectly good squad car while doing it, not to mention grossing out everybody else in the station house or jail.

The police are at 36th Street every weekend without fail. I pass through there every early Saturday and Sunday around 3:30 / 4am on the way work. You can have the homeless occupying a 4-seat area at the end of the car with their shopping cart and possessions and the officers with ignore them.

But if one of those prom / party goers is sleeping or passed out on more than one "seat" (bit harder to define on NTT blue benches) out comes the baton or folding stick and BANG-BANG-BANG on the grab poles to wake them up. Sometimes sitting up is enough, but others they'll do to them what they did to Ms. Wilson up there.

The same level of police presence - sometimes up to 6 officers - happens on the A/C/F platforms at Jay Street, the platforms at DeKalb Avenue, and at Atlantic Avenue.

Honestly, it feels like I see more police on the trains at night than I do during the day. I don't believe that they are out there strictly to fill ticket quotas, but writing them is one way to justify their seemingly expanded presence at night.

That's my 2-cents.

But since she also placed her foot on a seat (which is not allowed as per paragraph 2), her results could vary.

What she should have done is put her leg up but have her foot hang off of the edge of the seat... in this way she is neither violating the letter or spirit of the law.

Like Robots? Fine. Then they should do this to all of the homeless people as well, and a cop should be fined $50 for failing to enforce the law against certain individuals, with the person reporting it getting the $50.

They are a 'quality of life' problem. And from a financial out look, that 1 bum taking up one car prevents 50~ people from getting to their destination. and not to mention the amount of cleaning needed to clean up the 'stain' they leave behind.

Lawyers that are so adamant to keep those bums in the system should 'adopt a bum' by bringing one to their apartments for a week and see how long they'd like to put up with them.

The cops should all be suspended for 2 weeks - it was harassment, and she ought to sue.
No one was prevented form sitting down and they ought to have other things to do at 1am.

It's like the way the Suffolk County police spent weeks raiding several Asian massage parlors and busting about 25 women. Basically a victimless "crime," yet the cops give it more priority than rounding up drug dealers. That's because they are cowards. The women at the massage parlors are not dangerous. Drug dealers can be. So the cops ignore the drug dealers.

Isn't that breaking the law? The Law doesn't deal in degrees. "Only my bumper was in the bus stop! Stop writing that ticket!" is no different than "My leg was hurt so I put just my ass on this seat and my foot on that one."

Suspended for what? For doing their job? Although there are two sides to every story I admit that was an unnecesary summons, but it WAS legal and not harassment. Unfortunately it was from pressure from up above to produce numbers so that the high bosses can justify themselves at Comstat. This was all started by that idiot Giulliani.

It's bullshit. I remember I was taking the R a few months ago and it was 8 a.m. and I got ticketed for the exact same reason. The train had a seated load for what it was worth, but it wasn't SRO. The cop pulled me off the train @ 36th Street and I had to wait 30 minutes for the next (R) train because there were some (R)s dropping out at 59th Street and I had to go to 86th. Hopefully that cop is no longer breathing lol

Except at TAB, there is no such thing as a "fair, impartial hearing". IINM, they have a conviction rate above 90%, and I'm certain those Admin Law Judges are "encouraged" to bring in a certain amount of tickets guilty, no matter what, just as the NYPD does with the Compstat system mentioned by Jeff Rosen. It's not a quota, it's a "productivity goal".

We have heard stories like this before and, sadly, we will be hearing more similar stories in the future. These cops have quotas and they will write their own mothers to fufill them. Quotas come from #1PP and are filtered down the chain of command. Same with Stop-and-Frisk. Eventually you will find someone with a weapon or narcotics! Moral of the story: stop/frisk=good arrest stats and ticket quotas=$$$.

The cops have jobs to do, and if they don't some other jackjass will report them for not doing their job or favoring the white lady.
The cops are there, not for entertainment, but to follow the letter of the law as writen.
She is free to take it up with the judge, or see it legal way and pay the ticket.

The cops have quotas, pure and simple. I have heard that from lots of NYPD cops, active and retired. When your sgt is up your ass (like his lieut is up his!) to produce, your are gonna write people like this lady. Quotas have always existed in the NYPD, believe me!

I get a laugh out of all the neophytes who think they know the law or how the cop should have reacted. I'll be willing to bet that the cop probrably told her to put her leg down and then the whiny hipster just HAD to ask the cop why he had the audacity to tell her that when the train car was almost empty. After that, she got a summons. I know the type very well.

BTW for the record I personally wouldn't have ticketed her. I would have ejected her IF she gave me lip.

If the MTA wants revenue so badly why can't you just buy a monthly or yearly relaxation pass for off-peak trains?

Of course a better solution would be to make individual police officers individually liable every time a ticket they issue is thrown out of court.

And that's the problem some of these people don't realize:

We are in a society where unfortunately, if you say allowed it in this case and then in another where a train is much more crowded and the seats are actually needed someone is told the seats are needed and is written up, the person(s) who is(are) written up for it could take it the wrong way and get those who are simply looking for an excuse to bring attention to themselves involved even though such people will make it look like they are "helping" the person who was "wronged" in the latter case.

The cops are simply in a "dammed if you do, dammed if you don't" situation and it will be unpopular with whichever way it doesn't work out no matter what in situations like that.

The cops followed the letter of the law, not the purpose, which is not to make people stand. They decided to be robots, not use common sense, and turn this into a ticket quota scheme.

The remark they made "lucky we don't cuff you" ought to get it thrown out, if not a brutality suit.
