Although this is an AWESOME FEATURE (I got MobileMe for it when that was necessary), I wonder how many thieves know how to disable it and how soon they would turn the phone off?

It's a cold fact of nature that thieves are generally stupid. They don't know and probably wouldn't care less about the feature, let alone how to disable it.

If turning the iPhone off is the thief's method of choice to deactivate the feature, he may have been better off stealing a brick.

"The person who had the phone is not the person who stole the phone," Zambuto said.

They didn't say if the woman was held up or had her pocketbook opened. The person who stole the phone sold it for quick cash ?

That is true.

Turn it off, bring it home, restore iTunes firmware, set up as new phone. Criminals probably aren't going to know to do that.

As was the case here. Thief steals iPhone, Police track iPhone's location, iPhone recovered from a third party.

The thief probably knows that the cops are on his tail so he quickly sells the phone to an unsuspecting third party. When police catch said third party, they bust him on possession of stolen property charges.

The unsuspecting third party should not be charged. Under New York law, in order to find a person guilty of criminal possession of stolen property, that person must "knowingly" possess stolen property. If the person is "unsuspecting" then that person does not know the telephone to be stolen.
