He did not know that they were officers. As far as he was concerned, they were home invaders. He probably perceived what sort of people his neighbors were, maybe who the previous tenant was. He was in a dangerous situation, and cops in tactical gear simply look like monsters.

He did not INTEND to kill a cop, he did not INTEND to kill anybody until his home was invaded. When you invade someone's home, be you cop or not, you need to be prepared for a reaction. Cops are trained to deal with and survive reactions. Homeowners are not so trained.

If the BART incident was an accident, this one was not. Violence was expected by the officers, that they did not kill Cory was a miracle in itself, it showed some restraint and professionalism on the part of the officers. That an officer was killed proves that they need to do still more training.

Bottom Line: Cory did not invade anybody's home, he was not on the streets, he was not a public threat. The officers were.
