When I worked for NYNEX I was aware of a contract bid that my colleague was managing that definitely involved material changes from the RFP. All the bids came in too expensive, so in the negotiation process the end contract got significantly changed from the RFP.

Let me suggest a common scenario that might have happened. One of the companies stated in its proposal that if certain changes to the specifications were made then it had a design approach that would significantly reduce the cost. This bidder may also have included some technical information regarding this change in his proposal. This bidder also stated that the information in the proposal could not be divulged by NYNEX to other parties without the bidder's consent. None of the other bidders presented in their proposal any suggestion by which the cost might be reduced.

At this point NYNEX was free to discuss material changes with this bidder and was not under any obligation to notify the other bidders of any changes to the specifications.
