There is nothing wrong with creating a situation to "test" an illegal policy.Does the name Rosa Parks mean anything to you? How about lunch counter sit-ins? Even Plessy v. Ferguson, the case that led to the odious separate-but-equal rule more than 100 years ago, was a deliberate provocation orchestrated with the cooperation of the railroad, which wanted to eliminate the costly practice of providing separate facilities for black people. Which is why they picked a person who was only one-eight black (the Supreme Court's opinion refers to him as an "octoroon") as the test plaintiff. Let's keep the blame where it belongs: on the people who are trying to intimidate others from exercising simple, traditional freedoms. |
